Introduction
Welcome to the Bolesat platform, owned by Ibtkar Al Isal Est., National ID 7040046489, which provides the electronic shipping bill issuance service through integration with approved shipping companies within the Kingdom of Saudi Arabia.
Your access to the platform and use of the services available on it constitutes your full agreement to comply with these terms and conditions. Therefore, please read this document carefully before registering or using any of our services. If you do not agree to any of the provisions contained herein, you must stop using the platform.
These terms and conditions aim to regulate the contractual relationship between Bolesat and the users, including registered customers and beneficiaries of the platform's services. They define the rights and obligations of each party and establish the legal framework for using the platform in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia, particularly the regulations issued by the General Authority for Transport and relevant regulatory bodies.
Bolesat reserves the right to amend these terms and conditions at any time, and users will be notified of any material changes through available means. Continued use of the platform after any amendments constitutes the user's acknowledgment and acceptance of the updated terms.
1 Definitions
For the purposes of these terms and conditions, the following terms shall have the meanings set forth next to each, unless the context requires otherwise:
"Bolesat" or "the platform" or "the site" or "the application" or "we" or "second-person and possessive pronouns" refers to the electronic platform owned by Ibtkar Al Isal Est., which acts as a technical intermediary between customers and shipping companies, providing shipping bill issuance services for stores in the Kingdom of Saudi Arabia. This also includes the website and applications affiliated with Bolesat, and all electronic services provided through them, enabling users to select shipping companies, issue shipping bills, and manage their shipping operations.
"User" or "you" or "second-person pronouns" refers to any individual or business entity accessing the Bolesat platform or using any of its services, whether they have a registered account on the platform or not. This includes all customers, stores, companies, visitors, and anyone browsing the platform or benefiting from its services in any form. The user is legally bound by the terms and conditions upon using the platform or any of its services, whether registered or not.
"Client" refers to any individual or business entity registered on the platform to use its services, including e-stores and companies, and includes users who issue Bolesat shipping labels or benefit from the services provided through the platform.
"Shipping Company" refers to any transport or logistics company contracted with Bolesat to provide shipping services, including companies such as SMSA, Aramex, J&T Express, and any other companies cooperating with the platform.
"Store" refers to any business entity or individual who owns and operates an electronic or physical store, and uses the Bolesat platform to issue shipping labels for their customers.
"Shipping Label" refers to an electronic document issued through the platform, containing shipment data such as sender, recipient, weight, dimensions, address, and costs, and constitutes a contract between the client and the shipping company for the transport of goods according to the specified terms.
"Services" refers to all services provided by Bolesat through the platform, including issuing shipping labels, managing shipping operations, tracking shipments, technical integration with shipping companies, and any other services related to the shipping and logistics sector.
"E-Wallet" refers to the financial balance available in the client's account on the Bolesat platform, which is preloaded through the available payment methods, and is used to pay the cost of shipping labels and other services.
"Technical Integration" refers to the electronic connection between Bolesat and shipping companies, which enables data exchange and the automated execution of issuing and tracking shipping labels without manual intervention.
"Fees" or "Costs" refers to the financial amounts due for the services provided through the platform, including the cost of issuing labels, shipping fees, and any additional costs determined by the shipping company or the platform.
"Label Duration" refers to the time period during which the client can use the shipping label after issuance, which is set at seven (7) days from the date of issuance, after which it becomes invalid for use.
"Shipment" refers to any package or goods shipped via a Bolesat issued shipping bill from the platform, which must comply with the shipping standards approved by the shipping companies.
"Shipping Duration" refers to the expected timeframe for the shipment to reach its destination, usually ranging between 1 to 5 business days, and may vary according to the shipping company and operational conditions such as seasons and official holidays.
"Prohibited Materials" refers to goods that are prohibited from being shipped according to the regulations of the General Authority for Transport in the Kingdom of Saudi Arabia or the policies of shipping companies, including hazardous materials, flammable items, legally banned goods, or any other materials specified by the competent authorities.
"Financial Settlement" refers to the processes related to managing payments and dues between the client, the platform, and the shipping companies, including balance top-ups, discounts, and amounts consumed in issuing Bolesat.
"Client Account" refers to the electronic account registered on the Bolesat platform, which enables the client to manage their orders, top up their electronic wallet, issue Bolesat, track shipments, and follow up on related financial transactions.
"General Authority for Transport" refers to the governmental body responsible for regulating the transport sector and logistics services in the Kingdom of Saudi Arabia, overseeing compliance with shipping regulations and the rules governing services provided through the platform.
"Rating" refers to the client’s opinion on the level of service provided by the shipping company through the platform, based on criteria including delivery speed, service quality, handling of the shipment, and adherence to shipping terms. The rating system is subject to the controls set by the General Authority for Transport and is used to improve service quality and enhance transparency among parties.
"Damage" refers to any harm caused to the shipment during transport, with each party bearing responsibility according to the terms of the approved shipping company.
"Complaints and Disputes" refers to any claims or objections submitted by users regarding the services provided through the platform, which are handled according to the mechanisms stipulated in the terms and conditions.
"Privacy Policy" refers to the provisions that define how personal data of users is collected, used, and protected when they use the Bolesat platform, which complies with the Saudi regulations related to data protection.
"Agreement" or "Terms and Conditions" refers to this document that sets the legal framework for using the Bolesat platform, including the rights and obligations of all parties, and is updated periodically according to operational requirements and applicable regulations.
"Force Majeure" refers to any event or emergency circumstance beyond the control of any party, such as natural disasters, government decisions, wars, strikes, or major technical outages, which may affect the ability of the platform or shipping companies to provide services according to the agreement.
"Changes" or "Amendments" or "Updates" refers to any modifications or updates that may occur to the terms and conditions of the Bolesat platform or the services provided through it, which may be applied at any time.
"Regulation" or "Law" refers to all applicable laws, regulations, rules, and decisions in force in the Kingdom of Saudi Arabia, which govern the transactions and services provided through the Bolesat platform, including the rights and duties of the concerned parties, as well as any amendments or additions that may occur from time to time.
2 Scope of Services
Description of Services:
Bolesat is an electronic platform specialized in issuing shipping Bolesat for e-stores, acting as a technical intermediary linking customers with approved shipping companies in the Kingdom of Saudi Arabia. The platform enables e-stores and business owners to select suitable shipping companies and issue shipping Bolesat easily through direct technical integration with shipping companies such as: (SMSA, Aramex, G&T, other shipping companies that may be added later).
Service Features:
The Bolesat platform provides many features for customers, including for example:
Direct integration with shipping companies: where Bolesat are issued directly from the system approved by each shipping company.
Display the final price before issuance: No additional fees are charged after completion of issuance, and the predetermined amount is deducted from the client's electronic wallet.
Ease of shipment tracking: The system allows tracking the status of issued Bolesat through the client's user interface.
Centralized shipment management: Stores can manage all their shipments from one place, saving time and effort.
Ability to link the online store: The platform provides API integration options to enable stores to automatically issue Bolesat upon completion of sales transactions.
Mechanism of Bolesat:
The client can benefit from Bolesat services through the following steps:
Create an account on the platform and provide the required information correctly.
Top up the electronic wallet with a sufficient amount to cover the fees of the required Bolesat.
Choose the appropriate shipping company based on available prices and services.
Enter shipment details, such as: (sender and recipient address, shipment dimensions and weight, any notes or additional services available from the shipping company).
Complete the payment and issue the shipping Bolesat electronically.
Print the Bolesat and attach it to the shipment before handing it over to the selected shipping company.
3 Eligibility
Legal Capacity:
The Bolesat platform provides its services only to individuals who have full legal capacity to enter into legal transactions. Therefore, users and clients must be legally qualified to perform legal acts through the platform and to enter as parties in the contracts in which they participate.
Corporate Eligibility:
To use Bolesat and benefit from its services, the company or online store must be legally registered in the Kingdom of Saudi Arabia and possess a valid commercial registration (if required according to the commercial activity). Also, all stores and companies must comply with the laws and regulations applicable in the Kingdom of Saudi Arabia, including the regulations of the General Authority for Transport related to shipping and logistics services.
Minimum Age:
The client requesting any of our services through the Bolesat platform must be at least 18 years old or have reached the legal age specified under the applicable regulations in the Kingdom of Saudi Arabia, and must have the capacity to fully understand and be aware of all their legal actions.
Minors and Supervision:
If any user of the Bolesat platform is under 18 years old or has not reached the legal age applicable in the Kingdom of Saudi Arabia, they must use the platform's services under the supervision of a parent or legal guardian. The parent, custodian, or legal guardian bears full responsibility for all consequences resulting from the minor's use of the services.
User Acknowledgment:
The user hereby acknowledges in all cases that they are legally qualified to use the services of the Bolesat platform, and that this acknowledgment is made at their own personal responsibility, without Bolesat or its operators bearing any legal liability.
4 Applicable Saudi Regulations
General Authority for Transport Regulations:
All shipping services issued through the platform comply with the regulations and rules issued by the Saudi General Authority for Transport, including rules related to cargo shipping, transport controls, packaging standards, and permitted weights. The platform is not allowed to be used to issue Bolesat for shipping prohibited materials according to the General Authority for Transport regulations or shipping companies' policies.
E-Commerce Law (Issued by Royal Decree No. M/126 dated 07/11/1440 AH):
Since Bolesat operates as an electronic platform, it complies with all provisions of the E-Commerce Law in the Kingdom of Saudi Arabia, including transparency in displaying services and prices, and commitment to protecting customer data. All fees and final prices are clearly disclosed before completing any transaction.
Anti-Cybercrime Law (Issued by Royal Decree No. M/17 dated 08/03/1428 AH):
Bolesat prohibits any illegal use of the platform, such as entering false or fraudulent data, or misuse of the electronic system in any way that may harm the platform or other parties.
Personal Data Protection Law (Issued by Royal Decree No. M/19 dated 09/02/1443 AH):
Bolesat is committed to protecting the data of customers, stores, and companies, and not using or sharing it with any external party except in accordance with Saudi regulations or upon an official request from the competent authorities. Customer data is used solely for the purpose of providing and improving services in accordance with the approved privacy policy.
Anti-Commercial Fraud System (issued by Royal Decree No. M/19 dated 23/4/1429 AH):
It is prohibited for any customer or store to use the platform to issue Bolesat for shipping counterfeit, fake, or non-compliant products, and the customer is fully responsible for the accuracy and correctness of the products shipped through the platform.
Compliance with Shipping Companies' Terms:
In addition to complying with Saudi regulations, all users of Bolesat must adhere to the terms and policies of the contracted shipping companies, which may include:
Weight and dimension policies for each shipping company.
Required packing and packaging rules to ensure the safety of shipments during transport.
Lists of prohibited materials that cannot be shipped.
Compliance with Governmental and Judicial Requests:
Bolesat reserves the right to comply with any governmental or judicial orders requiring the provision of information about customers or transactions conducted through the platform, in accordance with the applicable Saudi regulations.
5 Account Policy
Account Creation:
The user must register a personal account on the Bolesat platform to benefit from our services. This includes providing accurate and complete information upon registration. The user undertakes to update their personal data if any changes occur, in order to maintain account accuracy.
Registration Requirements:
The user must provide the required data in the registration form accurately and transparently, in addition to any additional information that the platform management may request to activate the account or complete the registration process.
Accuracy of Information:
The user is responsible for providing accurate and complete information upon registration. The Bolesat platform bears no legal responsibility for errors or incorrect data provided by the user.
Account Security:
The user must choose a secure password when creating the account and maintain the confidentiality of the password. The user bears full responsibility for any activity that occurs in their account. The user is advised not to share account details or the password with any other party. In case of suspicion of any breach or unauthorized use of the account, the user must notify the Bolesat platform immediately to take the necessary actions.
Account Usage:
The user is authorized to use their account on the Bolesat platform only for legal purposes and in compliance with the terms and conditions. The user bears full responsibility for all activities conducted using their account.
Account Closure:
The user can close their account at any time by sending an official request to the Bolesat platform. The account will be closed after processing the request. In case of closure, the user is responsible for any pending transactions or those not executed after the account closure.
Account Cancellation:
The Bolesat platform reserves the right to cancel or suspend accounts if the user commits any violation of the terms and conditions or uses the account for illegal purposes or breaches the platform's policy. In case of cancellation, the user will be notified of the action taken and the reason behind the account cancellation.
Privacy and Data Protection:
All personal data provided by the user is handled in accordance with the privacy policy adopted by the Bolesat platform. The user agrees to the collection and use of their personal data only for the purpose for which it was provided, and has the right to modify their data at any time through their account.
Account Responsibility:
The user remains responsible for any activity conducted through their account, whether the user performed the activity or another person obtained permission to use the account. In the event of any breach or damages due to unauthorized use, the user commits to indemnify the Bolesat platform for any losses or damages that may result.
Account Licensing:
The account service on the Bolesat platform is provided under a usage license. The platform management has the right to withdraw this license, suspend the account, or terminate its use at any time without the need to provide reasons.
6 Service Pricing Policy
Price Determination:
Shipping Bolesat prices are determined based on the prices previously agreed upon between Bolesat and the integrated shipping companies with the platform, such as SMSA, Aramex, and J&T, as follows:
The Bolesat platform offers competitive prices for shipping Bolesat, with prices starting from 28 Saudi Riyals.
The final price of the Bolesat is clearly displayed to the customer before payment so that the customer is fully aware of the cost before completing the transaction, as the Bolesat cannot be canceled or modified after issuance. The customer is obligated to pay all costs and fees of the shipping Bolesat in advance before its issuance is completed.
All prices are subject to change according to the pricing policies of the shipping companies or updates of the Bolesat platform. The shipping cost depends on the selected shipping company, the actual or volumetric weight (whichever is greater), the destination, and any additional fees applied by the shipping company.
Prices include all fees related to the shipping process as determined by the shipping companies, with the possibility of adding optional services that may lead to additional fees.
Additional Fees:
Bolesat does not impose any hidden fees, and the customer is fully informed of the total cost before payment. Additional fees may apply if special services offered by the shipping companies are selected, such as express shipping or special delivery services, according to what is determined by the shipping company. There are no default insurance fees, as Bolesat does not provide insurance services on shipments; this is subject to the internal policies of the shipping companies integrated with the platform.
Government Fees:
All prices announced on the platform include the fees prescribed according to the regulations of the Kingdom of Saudi Arabia. In case any new fees are imposed by the competent regulatory authorities, Bolesat reserves the right to adjust prices to reflect those changes.
Value Added Tax:
All announced prices do not include value-added tax, which will be added to the final invoice according to applicable laws. The announced prices may be subject to additional taxes or fees, and the customer bears the responsibility to pay any new tax obligations imposed after the booking date.
Pricing Updates:
Bolesat reserves the right to amend the pricing policy in accordance with any changes in shipping costs or fees of contracted shipping companies. Users will be notified of any material changes in prices in the event of the inability to deliver any existing orders, through the communication methods approved by the platform.
This pricing policy is considered an integral part of the general agreement between the Bolesat platform and the client, and the client is deemed to have agreed to the pricing policy upon completing the booking or payment. In case of any dispute regarding prices or payments, reference shall be made to the platform management for resolution.
7 Offers and Discounts Policy
Validity of Offers and Discounts:
All offers and discounts provided by the Bolesat platform are limited to a specific time period, and their terms are clearly announced before activation. Offers are subject to special terms and conditions determined for each offer separately, and customers must review the offer details before benefiting from it. Bolesat reserves the right to modify or cancel any offer or discount without prior notice, if necessary.
Mechanism for Benefiting from Offers:
Offers are provided either in the form of direct discounts on shipping Bolesat prices, or through vouchers or discount codes that the user can enter at payment. Some offers may be designated for specific categories of customers, such as new users or large stores, according to the announced terms. More than one offer or discount cannot be combined in a single transaction unless explicitly stated in the offer terms.
Fair Use of Offers:
Users are not allowed to exploit offers in illegal or fraudulent ways, such as creating multiple accounts to benefit from the same offer multiple times. Bolesat reserves the right to cancel any discount or offer exploited illegally, and this may lead to suspension of the user’s account in case of repeated violations.
Refund of Offer Values:
If a shipping Bolesat is canceled or not used within the specified period (7 days), the discount value used in the Bolesat cannot be refunded or compensated. If the offer includes additional balance in the electronic wallet, this balance cannot be converted to cash or refunded by any other means.
8 Booking Policy
Booking Process and Issuance of Bolesat:
Customers can book and issue shipping Bolesat through the Bolesat platform after completing login to the account and topping up the e-wallet with sufficient balance. Upon selecting the shipping company and entering the shipment details, the final price of the Bolesat is displayed before completing the issuance, and it cannot be modified thereafter. Once the booking is confirmed, the Bolesat is issued immediately and sent to the customer via email or through their account on the platform.
Validity of the Bolesat:
All issued shipping Bolesat are valid for 7 days from the date of issuance and must be used within this period. If the Bolesat is not used within the specified period, it is considered invalid and its value cannot be refunded.
Data Entry and Review:
The customer is obligated to enter the shipment data accurately and correctly before issuing the Bolesat, and the customer bears all consequences arising from incorrect data entry.
Booking Restrictions:
The Bolesat platform has the right to impose limits on the number of Bolesat that a customer can book daily or monthly, to ensure fair use of the service. The platform reserves the right to reject any booking if there is suspicion of illegal or fraudulent activity. Note that some shipping companies may impose restrictions on the types of goods or supported destinations, and the customer must review the terms of the selected shipping company before booking.
Booking Amendments:
Once the Bolesat is issued, its details (such as changing the address, weight, or content) cannot be modified. In case of an error in data entry, the customer can issue a new Bolesat with the correct data, but the amount paid for the previous Bolesat will not be refunded.
Booking Confirmation and Notifications:
Once the booking is completed, a confirmation is sent via email or notifications within the platform, including the Bolesat details and tracking number if available. In some cases, the booking may require additional verification procedures from the customer to ensure the accuracy of the provided data, which may delay the issuance process.
Automatic Cancellation of Unpaid Bookings:
If there is insufficient balance in the client's wallet, they will not be able to complete the booking and must recharge the wallet first. If the client does not complete the payment within a certain period, the booking may be automatically canceled.
Force Majeure Cases:
In the event of exceptional circumstances such as natural disasters or technical issues that lead to booking failure or inability to use the Bolesat, Bolesat will review each case individually and find appropriate solutions, without this constituting a legal obligation to refund the paid amount.
When booking, the client agrees to the terms and conditions of the selected shipping company, including allowed weights, dimensions, and prohibitions. The client is advised to review the booking details before completion, as no modifications can be made after issuance.
9 Cancellation Policy
Non-Cancellability:
Once a shipping Bolesat is issued through the platform, it cannot be canceled, modified, or refunded, as the data is processed directly with the selected shipping company. The client is obligated to verify all shipment details and price before completing the booking, as cancellation of Bolesat for any reason after issuance is not permitted.
Bolesat Expiry:
All issued Bolesat are valid for 7 days from the date of issuance, and the client must use them within this period. If the Bolesat is not used within its validity period, there will be no extension, compensation, or refund of the paid amount, and this is the full responsibility of the client.
Cancellation Due to Issuance Error:
In case of a technical error in issuing the Bolesat or if there was an error by the platform that led to issuing an incorrect shipping Bolesat, the client can contact Bolesat platform support within 24 hours of issuance to consider the possibility of resolving the issue according to each case. Note that the platform and Bolesat bear no responsibility for errors resulting from the client entering incorrect or incomplete data.
Cancellation Due to Pricing Error:
In the event of a pricing error in Bolesat resulting from a technical fault or an integration issue with shipping companies, Bolesat platform has the right to cancel the Bolesat and refund the amount to the customer's wallet. Bolesat bears no responsibility for any losses or additional costs incurred by the customer due to the cancellation of the Bolesat for any legitimate reason.
Cancellation Due to Payment Issues:
If the customer attempts to issue a Bolesat but is unable to pay due to insufficient balance in their electronic wallet, the issuance will not be completed, and the Bolesat will not be reserved until the balance is topped up and the issuance is retried. Any reservations not completed will not be retained and may be automatically canceled without any obligation from Bolesat.
Cancellation by Bolesat:
Bolesat reserves the right to cancel any issued Bolesat in the following cases:
If it is found that the information provided by the customer is incorrect or misleading.
In case of suspicion of fraud or misuse of the service.
If the selected shipping company refuses to process the shipment for any legitimate reason according to its internal policies.
In case of non-compliance with Saudi regulations or when attempting to ship prohibited items under the law or the General Transport Authority’s regulations.
If Bolesat cancels the Bolesat for any of the aforementioned reasons, the customer will not be eligible for a refund of any paid amounts.
Cancellation Notifications:
Customers are clearly notified of the cancellation policy before completing the payment and issuance process. In case of any changes to the cancellation policy regarding existing orders, customers will be notified through the official means approved by Bolesat.
10 Shipping Policy
The Platform’s Role in the Shipping Process:
Bolesat acts as a digital intermediary connecting customers with approved shipping companies in the Kingdom of Saudi Arabia. Therefore, all shipping operations are conducted through contracted shipping companies and are subject to their terms and internal policies. The customer agrees to comply with these terms when selecting any shipping company through the platform. Note that the platform does not carry out shipping operations itself; thus, responsibility for delivery, duration, special cases, and delays lies with the selected shipping company.
Scope of Service:
Bolesat's service scope is limited to shipping within the Kingdom of Saudi Arabia only. The platform currently does not provide international shipping services or shipping to destinations outside the coverage area specified by the available shipping companies.
Shipping Address:
The shipping address you provide to us is subject to the following provisions:
The address must include (the full name of the recipient, a correct and reachable phone number, accurate address details "building number, street name, city, postal code, any additional details", any special instructions that may facilitate the delivery process).
The customer is responsible for entering the correct and complete shipping address when issuing the shipping Bolesat via the Bolesat platform. Any error or omission in the address may result in shipment delay or return, and the customer bears any additional costs arising from that.
The address cannot be modified after issuing the Bolesat, as shipping companies rely on the data entered at the time of issuance. If the customer discovers an error in the address after issuing the Bolesat, they may attempt to contact the shipping company directly to try to correct the address according to its policies.
If the shipping company is unable to deliver the shipment due to an incorrect address or the recipient's non-response, one of the following actions may be taken: (returning the shipment to the sender with the customer bearing the return and storage costs, imposing additional fees for re-delivery if this service is available from the shipping company, or canceling the Bolesat without any refund of the paid amount if the issue is not resolved within the period specified by the shipping company).
Some shipping companies may not cover certain areas within the Kingdom of Saudi Arabia, such as: (remote or desert areas, or locations without clear addresses or specific postal codes), and in these cases, the customer must choose the nearest available pickup point or contact the shipping company to know alternative options.
Shipping Duration:
The shipping duration varies according to the selected shipping company, type of service, and destination. The shipping duration is subject to the following provisions:
The expected standard delivery time within the Kingdom of Saudi Arabia ranges between (1-5) business days, but it may change according to the operational conditions of the shipping companies.
Bolesat does not guarantee delivery of shipments within a specific period, as the actual duration depends on the terms and conditions of each shipping company.
Shipping companies may face delivery delays during busy seasons such as Ramadan, holidays, and special occasions. In case of any official notifications from shipping companies regarding expected delays, customers will be notified via the platform or email.
Shipments directed to remote areas or those covered by shipping companies with limited service may take longer than the standard duration. Some shipping companies may impose additional fees or special schedules for these areas, and the customer should review the details before completing the order.
The shipping period starts from the date the shipment is received by the shipping company, not from the date the Bolesat is issued. Some shipping companies may have specific daily pickup times, which may affect the start date of shipping.
Shipment Tracking:
Bolesat provides a tracking link for each issued shipping Bolesat, and customers can monitor the status of their shipments through the tracking system of the selected shipping company by entering the shipment number and the shipping company’s name. Bolesat is not responsible for the accuracy or updates of the tracking information, as this information depends on the data from the shipping companies.
Shipping Delays and Liability:
The Bolesat platform is not responsible for any delivery delays resulting from factors beyond its control, such as: (severe weather conditions, seasonal congestion or increased demand for shipping, customs or regulatory procedures that may affect some shipments, errors in the customer’s address, or failure to receive the shipment by the customer). The customer is responsible for contacting the selected shipping company in case of any unexpected delay.
Delivery Failure and Non-Receipt:
If the customer does not receive the shipment within the period specified by the shipping company, one of the following procedures may be applied:
Returning the shipment to the sender, with deduction of any return or storage fees.
Imposing additional fees if the customer delays in receiving the shipment from the shipping company’s pickup points.
Canceling the Bolesat without any refund of the paid amount if the maximum retention period for the shipment expires.
Force Majeure Cases:

Natural disasters (floods, storms, earthquakes).
Government decisions affecting shipping operations.
Epidemics or public health crises.
Emergency security conditions.
11 Shipping Prohibitions
Legally Prohibited Materials:
Any illegal or prohibited materials under the laws of the Kingdom of Saudi Arabia or the laws of the countries to which shipping is made, including:
Drugs, intoxicants, all mind-altering substances, and hazardous chemicals.
Firearms, ammunition, explosives of all kinds, and flammable materials.
Radioactive, biological, or nuclear materials.
Counterfeit currencies or tools used for forgery.
Prohibited animals and animal products.
Materials Requiring Special Approvals:
Some materials can only be shipped after obtaining official permits from the competent authorities, including:
Medical products and pharmaceuticals.
Industrial chemicals.
Radiating electronic devices or those operating with certain wireless technologies.
Hazardous or Perishable Materials:
Including materials that pose a risk during transport, such as:
Compressed gases and flammable materials.
High-capacity batteries that may cause fire or explosion.
Toxic or corrosive materials.
Perishable foods or products requiring specific temperatures for preservation.
Materials Prohibited by Shipping Companies:
Shipments are also subject to the policies of contracted shipping companies (such as SMSA, Aramex, J&T), and some materials may be rejected based on their specific policies. The customer must review the selected shipping company’s policies before issuing the Bolesat to ensure the shipment complies with the required conditions.
General Shipping Restrictions:
The Bolesat platform imposes general shipping restrictions as follows:
Shipping of very heavy products or equipment or those exceeding 50 cm volumetric dimensions or weighing 25 kilograms is prohibited.
Shipping of suitcases of all types is prohibited unless they are factory sealed and completely empty.
Shipping of temperature-sensitive medications is prohibited, regardless of their type.
Shipping of identity cards, personal identification documents, or any documents that may harm the interests of the parties is prohibited.
Shipping parcels between the same sender and recipient or between members of the same family is prohibited.
Shipping of cash, checks, bonds, and bullion is prohibited.
Shipping of antiquities subject to the Antiquities, Museums, and Urban Heritage System is prohibited.
12 Inspection and Confiscation
Security Inspection of Shipments:
Contracted shipping companies through the Bolesat platform reserve the right to open and inspect any shipment to ensure compliance with the regulations and laws in force in the Kingdom of Saudi Arabia, as well as to verify that the shipment does not contain any prohibited or dangerous materials. Inspections are conducted in accordance with the regulations approved by the Saudi General Transport Authority and in line with the policies of each partner shipping company. Bolesat bears no responsibility for any damage that may occur to the shipment as a result of security inspections conducted by shipping companies or competent authorities.
Cases Requiring Inspection and Confiscation:
The shipping company has the right, based on directives from competent authorities, to open the parcel and inspect its contents in the following cases:
If it is suspected that the shipment contains prohibited or restricted materials under the Kingdom of Saudi Arabia’s regulations.
If required according to random inspection policies or security procedures followed.
Upon an official request from security or regulatory authorities.
When there is suspicion that the customer has provided incorrect or misleading information about the shipment’s contents.
Confiscation of Violating Shipments:
In case prohibited or illegal materials are discovered inside the shipment, the following actions will be taken:
Notifying the competent authorities to take appropriate legal actions.
Confiscation of the entire shipment without any compensation to the sender or recipient.
Listing the sender on the blacklist if violations are repeated or if intentional sending of illegal materials is proven.
13 Weight and Dimension Policy
Compliance with Approved Standards:
Shipment weights are calculated according to the rates outlined on the Bolesat platform, based either on the actual weight or the volumetric weight, whichever is greater. The customer is responsible for accurately entering the weight and dimensions, as any error in this data may result in additional fees or shipment rejection by the shipping company.
Volumetric Weight Calculation and Billing Mechanism:
Actual Weight: The true weight of the shipment in kilograms.
Volumetric Weight: Calculated according to the shipment’s dimensions, and can be computed using the volumetric weight calculator on the Bolesat platform.
Shipping fees are calculated based on the higher weight between the actual weight and the volumetric weight.
If the shipment exceeds the base weight specified in the pricing, additional fees are charged on the excess weight.

Non-Standard Size Shipments:
If the shipment has non-standard sizes or irregular dimensions, additional fees may be charged due to the need for special handling. Non-standard shipments include non-cubic parcels, round shipments, long tubes, etc.
Customer Responsibility for Data Accuracy:
The customer is responsible for accurately entering the weight and dimension data when issuing the shipping Bolesat, and any error in the data may result in:
Rejection of the shipment by the shipping company.
Recalculation of the shipping cost and imposition of additional fees upon receipt of the actual shipment by the shipping company.
Delay in processing the shipment until the price differences are paid or the data is corrected.
Review and Modification of Shipping Data:
Shipping companies reserve the right to re-measure shipments upon receipt, and if a discrepancy is found between the entered weight or dimensions and the actual data, the price will be adjusted according to the actual volumetric weight. The Bolesat platform has the right to collect any additional fees resulting from these adjustments from the customer's electronic wallet balance, and if the balance is insufficient, the customer is obligated to complete the payment before shipping the shipment.
14 Customer Policy
Legal Eligibility:
The customer must be legally eligible to submit service booking requests through the Bolesat platform, in accordance with the applicable regulations in the Kingdom of Saudi Arabia. If legal eligibility is not met, the customer must refrain from entering into any transactions through the platform.
Account Creation:
The client is required to create an account on the Bolesat platform in order to submit and track requests. The client must enter accurate and correct data during registration, provided that this data is legal and verifiable.
Review of Service Details:
The client bears the responsibility to review all details of the advertised services before submitting the request. Confirming the request is considered final approval of the service, and refunds are only allowed according to the approved cancellation policy.
Compliance with Terms:
The client commits to all terms stated in the Bolesat platform usage agreement, including policies related to services and other regulations governing the use of the platform, and must comply with the applicable Saudi regulations while using the services.
Liability for Prohibited or Restricted Materials:
The client bears full responsibility for any damages or legal liabilities resulting from attempting to ship any prohibited or restricted materials according to the laws applicable in the Kingdom of Saudi Arabia. In case any shipment containing prohibited materials is discovered, the shipping company has the right to refuse or confiscate it without any compensation or refund of the paid amount. It is noted that the competent authorities may be notified if illegal shipments are suspected, and the client bears the legal consequences thereof.
Liability for Shipments:
The Bolesat platform is not responsible for shipments sent by the merchant or client, regardless of their type or contents. The sender (merchant or client) bears full responsibility for their shipment and its contents, and any legal accountability that may arise therefrom.
Disclosure of Shipment Contents:
If requested by the shipping company employee to disclose the contents of the shipment, the sender must provide accurate and truthful information about the shipment. Shipping any prohibited or unsafe product according to the laws of the Kingdom of Saudi Arabia is prohibited, and the sender bears full legal responsibility for any violation. The client undertakes to fully disclose the shipment contents and ensure their accuracy upon request.
Liability for Weights and Dimensions:
The client acknowledges that entering incorrect weights or dimensions may lead to price recalculation, shipment rejection, or delay. Shipping companies have the right to re-measure shipments, and if there is a discrepancy between the declared weight and the actual or volumetric weight, the cost will be adjusted according to the new actual or volumetric weight.
Commitment to Providing the National Address:
The client is obligated to enter the correct and complete national address of the recipient when creating any shipping request through the Bolesat platform, in compliance with the regulatory instructions issued by the General Authority for Transport in the Kingdom of Saudi Arabia, which require that postal shipments not be accepted or delivered without an approved national address starting from January 1, 2026. The client bears full responsibility for the accuracy and correctness of the entered national address data, including (building number, street name, neighborhood, city, postal code, and additional number). In the event of failure to enter the national address or entering it incorrectly, Bolesat or the transport company has the right to reject the shipment or suspend its execution without any liability on Bolesat.
Legal Liability Resulting from Concealing Information:
The client bears full responsibility for any damages or legal consequences resulting from concealing information related to the contents of the package. The sender is obligated to bear all legal consequences and responsibilities arising from the violating shipment, including any fines or penalties imposed by regulatory authorities.
Liability for Confiscated Shipments:
The Bolesat platform does not bear any legal or financial responsibility for shipments confiscated due to violation of regulations or shipments containing prohibited materials. Any damage or delay resulting from inspection or confiscation procedures falls within the responsibility of the client or sender.
15 Payment Policy
Available Payment Methods:
All payment transactions within the Bolesat platform are conducted through the client’s electronic wallet, which must be preloaded to use the services. Bolesat does not support cash payment or payment on delivery; all payments are made electronically only through the platform.
Payment Completion:
When using the platform’s services, the due amount is automatically deducted from the client’s electronic wallet upon order completion. The client is responsible for loading their wallet with sufficient funds to ensure the execution of orders without delay.
Non-Refundable:
All payments made through the platform are final and non-refundable, and the customer must verify the accuracy of their information before confirming the payment. In case of a technical error or transaction issue, the customer can contact customer support, and the case will be reviewed according to Ibtkar Al Isal Est.'s internal Bolesat policies.
Responsibility for Payment:
The customer is obligated to monitor their account activity and ensure there is no unauthorized use of their electronic wallet. Bolesat reserves the right to suspend or block the account if any suspicious or fraudulent payment activities are detected.
16 Electronic Wallet Policy
Creating the Electronic Wallet:
An electronic wallet is automatically created for each user upon registering their account on the Bolesat platform, and it is used to complete payment transactions for available services.
Wallet Recharge:
The customer can recharge their electronic wallet using approved payment methods, such as bank transfer or electronic payment through authorized service providers. No interest or profits are accrued on the wallet balance, as it is used solely as a payment method within the platform.
Use of Balance:
The available balance in the wallet can be used to issue shipping Bolesat and pay fees due on orders. The amount is automatically deducted from the wallet once the customer completes the purchase of the Bolesat.
Non-transferability of Balance:
The customer cannot transfer the available balance in their wallet to other accounts within the platform or to external bank accounts. The wallet balance is non-refundable in cash and can only be used within the Bolesat platform.
Balance Validity:
The balance added to the wallet remains valid as long as the account is active. In case the account is inactive for a long period, a policy of cancellation or freezing of the balance may be applied at the discretion of the platform management.
Account Responsibility:
The client bears full responsibility for managing their electronic wallet and must take the necessary measures to protect their account from any unauthorized use. In case of suspected fraud or misuse of the wallet, Bolesat reserves the right to suspend or block the account and take the necessary legal actions.
17 Refund Policy
Refund Cases:
Refunds are made only in cases of cancellation acceptance according to the platform's cancellation policy.
Refund to Electronic Wallet:
The paid amount will be refunded to the client's electronic wallet, and the refunded amounts cannot be transferred to bank accounts or any other payment methods, as they remain within the electronic wallet for future use by the client on the Bolesat platform. Refunds are only processed within the platform and amounts are not returned in cash or through any other payment method.
Refund Procedures:
If the refund request is accepted based on the cancellation policy, the Bolesat team will evaluate the request and then execute the refund to the client's electronic wallet. The client can use the refunded balance to conduct new transactions within the platform or recharge their electronic wallet according to their needs.
18 Damage and Compensation Policy
Packaging Responsibility:
The client (merchant or sender) is obligated to properly and securely package their shipment before handing it over to the shipping company, and the packaging is subject to the following controls:
Packaging must be suitable for all sent materials and use the designated carton or shipment bag provided by the shipping company or by the client (sender).
For shipments containing fragile or sensitive materials, the shipment must be packaged with at least two layers, in addition to using bubble wrap or other special materials to protect fragile items from damage.
The client must affix a "Fragile" label on the shipment to alert the shipping company and the relevant workers of the presence of fragile materials inside the shipment.
Shipping Restrictions on Heavy Products:
The customer commits not to ship heavy products whose actual or volumetric weight exceeds the weight specified under the agreement with the shipping company. In case the shipment exceeds the agreed weight, excess fees or additional restrictions will be applied to the shipment, according to the policies of the concerned shipping company.
Liability for Damages During Transport:
In the event that the shipment is subjected to partial or total damage or breakage during transport, the liability for compensation shall be according to the policies followed by the shipping company, including investigations related to the condition of the shipment, and the customer must submit a claim to the concerned shipping company according to its related policies.
Limitation of Liability:
The liability of the parties is determined as follows:
The sender (customer) and the shipping company are the sole parties responsible for the contents of the shipment, and any damage or deterioration that may occur during or due to transport, or due to any other factors.
The Bolesat platform and its employees bear no responsibility or material or moral compensation regarding shipments after delivering the Bolesat to the customer (sender) or their representative.
Bolesat’s responsibility ends once the Bolesat (issued automatically, manually, or by any other means) is delivered to the sender or their representative.
Bolesat’s Non-Liability:
The Bolesat platform is not responsible for any material or moral damages or losses that may occur after delivering the Bolesat to the shipping company, and no legal or financial consequences related to damage or loss of the shipment during transport are borne. Furthermore, in the event of any damage occurring to the shipment, the Bolesat platform is not obligated to compensate the customer for such damages.
19 Reviews
Objectives of Reviews and Opinions:
Reviews aim to improve the quality of services provided based on customers' opinions and feedback. Reviews are considered a tool to enhance transparency and increase trust between the platform and customers, and a tool for service providers to view customer opinions and continuously improve their services.
Eligibility for Reviews:
Submitting reviews is allowed for customers or visitors who have benefited from the platform's services and/or service providers directly. The review must reflect a genuine personal experience and be honest, objective, and unbiased.
Review Content:
Reviews must be appropriate and free from any offensive language, threats, or illegal comments. It is prohibited to publish reviews that include: (false or misleading information, content that infringes intellectual property rights or trademarks, references or comparisons with other entities in an illegal or inappropriate manner).
Review Moderation:
The platform reserves the right to review all reviews before publishing to ensure compliance with this policy. The platform has the right to delete or modify any review that violates the stated terms without prior notice.

20 Usage Policy

Using the Bolesat platform services constitutes implicit agreement to comply with all the terms contained in this policy, in addition to other related policies.
Legal Eligibility:
The user must be legally eligible to use the services in accordance with the applicable regulations in the Kingdom of Saudi Arabia. If the user is a minor (under 18 years old), consent from a guardian or legal custodian is required.
Permitted Use:
Services must be used only for legitimate and authorized purposes. The following actions are prohibited:
Publishing or sending any illegal, offensive, or indecent content.
Attempting to hack or disrupt the platform’s technical systems.
Exploiting the services in ways that harm the platform’s reputation or disrupt its operations.
Using accounts or data belonging to others without permission.
User Obligations:
The user commits to providing accurate and correct data when creating an account or conducting transactions. The user is responsible for protecting the login data to their account and must not share this data with any other party. Responsibilities of Bolesat Platform:
The platform carefully selects third parties based on quality and efficiency standards, and periodically monitors the performance of third parties to ensure compliance with standards, but is not responsible for any damages beyond the scope of the concluded agreements.
Responsibilities of Users:

Exploitation of the platform’s intellectual property rights for any purpose that violates laws or conflicts with the platform’s objectives is prohibited, such as unauthorized commercial use or resale. Bolesat platform reserves the right to take appropriate legal actions against any infringement of its intellectual property rights, including claiming compensation for any damages or losses resulting therefrom. Using or browsing the platform’s services does not grant any rights or implicit licenses to users regarding any intellectual property rights belonging to Bolesat platform. Misuse of services:
The user is responsible for any misuse of the services provided by the Bolesat platform and bears the legal consequences and compensation for any resulting damages.
Abuse of the platform:
The user bears legal responsibility in case of abuse of the platform, whether through websites, applications, social media, email, or any other means.
Abuse of others:
The user bears full responsibility for any abuse or harm caused to others through the use of the Bolesat platform's services, and the platform bears no legal responsibility for that.
Compensation to the platform for damages:
The user commits to compensating the Bolesat platform for any losses or damages resulting from illegal or unauthorized use of the services, whether by the user or by those acting on their behalf.
Compensation for abuse:
The user commits to compensating the Bolesat platform for any abuse or damage directed at the platform's management, employees, partners, agents, or any related entity.
Preservation of legal rights:

The platform is not liable for any direct or indirect damages resulting from the use of its services, except in the case of gross negligence or clear fault on its part. Bolesat platform is also exempt from liability for any damages arising from misuse of the services or violation of the terms by the user.

Accuracy of Data:
The user is responsible for providing accurate and updated contact information and is liable for any consequences resulting from not receiving notifications due to incorrect or outdated data.
Administrative Notifications:
The user acknowledges that notifications sent by the Bolesat platform, including those related to updates of terms or policies, are considered properly received once sent via the specified method, even if they are not read.
Inquiries and Complaints:
Users have the right to contact the management of the Bolesat platform to submit their inquiries or complaints through designated channels, such as email or the contact form available on the platform. The platform commits to responding to these inquiries and complaints as soon as possible.
Changes and Announcements:

Acceptance of Amendments:

Effectiveness of Amendments:
The amendments shall come into effect immediately upon their publication on the platform or sending a notification to users, unless otherwise stated in the amendment itself.
30 Duration/Termination of the Agreement
Duration of the Agreement:
This agreement shall be effective from the date of the user's acceptance or the commencement of their use of the services provided by Ibtkar Al Isal Est., and shall continue until termination or cancellation of the agreement by either party in accordance with the terms of this agreement.
Termination of the Agreement:
Either party has the right to terminate this agreement at any time, with or without prior notice, in accordance with the applicable law and the terms specified in this agreement.
Consequences of Termination:
Upon termination of this agreement, the user shall immediately cease using any of the services of Ibtkar Al Isal Est., and certain provisions (such as those related to legal liability, intellectual property rights, confidentiality, etc.) shall remain effective after termination as stipulated.
31 Legal Jurisdiction and Competence
Governing Law:
This agreement and its execution are subject to the provisions of the applicable laws in the Kingdom of Saudi Arabia, and Saudi law shall be considered the governing law for any dispute arising from this agreement or related to the use of the platform's services.
Jurisdiction:
The user acknowledges that any dispute or disagreement arising between them and the Bolesat platform as a result of this agreement or the services provided through the platform shall be resolved before the competent courts in the Kingdom of Saudi Arabia, and this jurisdiction shall be considered exclusive.
Dispute Resolution by Alternative Means:
Before resorting to the courts, the parties have the right to attempt to resolve any dispute through alternative means such as negotiation or mediation, but this does not waive the right to resort to the courts when necessary.
Exclusion of Clauses:
If any clause of this document is canceled or excluded based on a judicial ruling, the remaining clauses shall remain valid and effective with their full legal effects, and this shall not affect their validity or enforcement, unless the management of the Bolesat platform decides to cancel the entire agreement.
32 Arabic Language

In the event of any translation of these terms into other languages, the Arabic version shall be the legally binding version. 1 التعريفات
لأغراض هذه الشروط والأحكام، يكون للمصطلحات التالية المعاني الموضحة قرين كل منها، ما لم يقتضِ السياق خلاف ذلك:
"بوليصات" أو "المنصة" أو "الموقع" أو "التطبيق" أو "نحن" أو "ضمائر المخاطب والملكية" يشير إلى المنصة الإلكترونية المملوكة لـ مؤسسة ابتكار الإيصال للتجارة، والتي تعمل كوسيط تقني بين العملاء وشركات الشحن، وتوفر خدمات إصدار بوالص الشحن للمتاجر في المملكة العربية السعودية، ويشمل ذلك أيضًا الموقع الإلكتروني والتطبيقات التابعة لـ بوليصات، وجميع الخدمات الإلكترونية المقدمة عبرها، والتي تتيح للمستخدمين اختيار شركات الشحن وإصدار بوالص الشحن وإدارة عمليات الشحن الخاصة بهم.
"المستخدم" أو "أنت" أو "ضمائر المخاطب" يشير إلى أي فرد أو كيان تجاري يقوم بالوصول إلى منصة بوليصات أو استخدام أي من خدماتها، سواء كان لديه حساب مسجّل على المنصة أو لم يكن كذلك. يشمل ذلك جميع العملاء، المتاجر، الشركات، الزوار، وأي شخص يتصفح المنصة أو يستفيد من خدماتها بأي شكل من الأشكال. ويُعد المستخدم ملتزمًا قانونيًا بالشروط والأحكام بمجرد استخدامه للمنصة أو لأي من خدماتها، سواء قام بالتسجيل أم لا.
"العميل" يشير إلى أي فرد أو كيان تجاري مسجَّل في المنصة لاستخدام خدماتها، بما في ذلك المتاجر الإلكترونية والشركات، ويشمل ذلك المستخدمين الذين يقومون بإصدار بوالص شحن أو الاستفادة من الخدمات المقدمة عبر المنصة.
"شركة الشحن" يشير إلى أي شركة نقل أو لوجستيات متعاقدة مع بوليصات لتوفير خدمات الشحن، وتشمل الشركات مثل سمسا، أرامكس، J&T Express وأي شركات أخرى تتعاون مع المنصة.
"المتجر" يشير إلى أي كيان تجاري أو فرد يملك ويدير متجرًا إلكترونيًا أو ماديًا، ويستخدم منصة بوليصات لإصدار بوالص الشحن لعملائه.
"بوليصة الشحن" يشير إلى مستند إلكتروني يتم إصداره عبر المنصة، يتضمن بيانات الشحنة مثل المرسل، المستلم، الوزن، الأبعاد، العنوان، والتكاليف، ويُعد بمثابة عقد بين العميل وشركة الشحن لنقل البضائع وفقًا للشروط المحددة.
"الخدمات" يشير إلى جميع الخدمات التي تقدمها بوليصات عبر المنصة، بما في ذلك إصدار بوالص الشحن، إدارة عمليات الشحن، تتبع الشحنات، التكامل التقني مع شركات الشحن، وأي خدمات أخرى متعلقة بقطاع الشحن واللوجستيات.
"المحفظة الإلكترونية" يشير إلى الرصيد المالي المتاح في حساب العميل على منصة بوليصات، والذي يتم شحنه مسبقًا من خلال وسائل الدفع المتاحة، ويُستخدم لدفع تكلفة بوالص الشحن والخدمات الأخرى.
"التكامل التقني" يشير إلى الربط الإلكتروني بين بوليصات وشركات الشحن، والذي يتيح تبادل البيانات وتنفيذ عمليات إصدار وتتبع بوالص الشحن بشكل آلي دون تدخل يدوي.
"الرسوم" أو "التكاليف" يشير إلى المبالغ المالية المستحقة مقابل الخدمات المقدمة عبر المنصة، بما في ذلك تكلفة إصدار البوالص، رسوم الشحن، وأي تكاليف إضافية تحددها شركة الشحن أو المنصة.
"مدة البوليصة" يشير إلى الفترة الزمنية التي يمكن للعميل خلالها استخدام بوليصة الشحن بعد إصدارها، والتي تُحدد بـ سبعة (7) أيام من تاريخ الإصدار، وبعد ذلك تصبح غير صالحة للاستخدام.
"الشحنة" يشير إلى أي طرد أو بضاعة يتم شحنها عبر بوليصة الشحن الصادرة من المنصة، ويجب أن تتوافق مع معايير الشحن المعتمدة لدى شركات الشحن.
"مدة الشحن" يشير إلى الإطار الزمني المتوقع لوصول الشحنة إلى وجهتها، والذي يتراوح عادةً بين 1 إلى 5 أيام عمل، وقد يختلف وفقًا لشركة الشحن والظروف التشغيلية مثل المواسم والعطلات الرسمية.
"المواد المحظورة" يشير إلى البضائع التي يُمنع شحنها وفقًا لأنظمة الهيئة العامة للنقل في المملكة العربية السعودية أو سياسات شركات الشحن، وتشمل المواد الخطرة، القابلة للاشتعال، الممنوعة قانونًا، أو أي مواد أخرى تحددها الجهات المختصة.
"التسوية المالية" يشير إلى العمليات المتعلقة بإدارة المدفوعات والمستحقات بين العميل، المنصة، وشركات الشحن، بما في ذلك شحن الرصيد، الخصومات، والمبالغ المستهلكة في إصدار البوالص.
"حساب العميل" يشير إلى الحساب الإلكتروني المسجَّل على منصة بوليصات، والذي يتيح للعميل إدارة طلباته، شحن محفظته الإلكترونية، إصدار البوالص، تتبع الشحنات، ومتابعة العمليات المالية المرتبطة به.
"الهيئة العامة للنقل" يشير إلى الجهة الحكومية المسؤولة عن تنظيم قطاع النقل والخدمات اللوجستية في المملكة العربية السعودية، وتُشرف على الالتزام بأنظمة الشحن واللوائح المنظمة للخدمات المقدمة عبر المنصة.
"التقييم" يشير إلى رأي العميل في مستوى الخدمة المقدمة من قبل شركة الشحن عبر المنصة، بناءً على معايير تشمل سرعة التوصيل، جودة الخدمة، التعامل مع الشحنة، والالتزام بشروط الشحن. يخضع نظام التقييم للضوابط التي تحددها الهيئة العامة للنقل، ويستخدم لتحسين جودة الخدمات وتعزيز الشفافية بين الأطراف.
"التلف" يشير إلى أي ضرر يلحق بالشحنة أثناء النقل، ويتحمل كل طرف مسؤوليته وفقًا لشروط شركة الشحن المعتمدة.
"الشكاوى والمنازعات" يشير إلى أي مطالبات أو اعتراضات يقدمها المستخدمون فيما يتعلق بالخدمات المقدمة عبر المنصة، والتي يتم التعامل معها وفقًا للآليات المنصوص عليها في الشروط والأحكام.
"سياسة الخصوصية" يشير إلى الأحكام التي تحدد كيفية جمع واستخدام وحماية البيانات الشخصية للمستخدمين عند استخدامهم لمنصة بوليصات، والتي تلتزم بالأنظمة السعودية المتعلقة بحماية البيانات.
"الاتفاقية" أو "الشروط والأحكام" يشير إلى هذه الوثيقة التي تحدد الإطار القانوني لاستخدام منصة بوليصات، وتشمل الحقوق والالتزامات المترتبة على جميع الأطراف، ويتم تحديثها دوريًا وفقًا لمتطلبات التشغيل والأنظمة المعمول بها.
"القوة القاهرة" يشير إلى أي حدث أو ظرف طارئ خارج عن إرادة أي من الأطراف، مثل الكوارث الطبيعية، القرارات الحكومية، الحروب، الإضرابات، أو الانقطاعات التقنية الكبرى، والتي قد تؤثر على قدرة المنصة أو شركات الشحن على تقديم الخدمات وفقًا للاتفاقية.
"التغييرات" أو "التعديلات" أو "التحديثات" يشير إلى أي تعديلات أو تحديثات قد تطرأ على شروط وأحكام منصة بوليصات أو الخدمات المقدمة من خلالها، والتي قد تُطبق في أي وقت.
"النظام" أو "القانون" يشير إلى جميع الأنظمة والقوانين واللوائح والقرارات المعمول بها والنافذة في المملكة العربية السعودية، والتي تنظم المعاملات والخدمات المقدمة عبر منصة بوليصات، بما في ذلك حقوق وواجبات الأطراف المعنية، فضلاً عن أي تعديلات أو إضافات قد تطرأ عليها من وقت لآخر.
2 نطاق الخدمات
وصف الخدمات:
بوليصات هي منصة إلكترونية متخصصة في إصدار بوالص الشحن للمتاجر الإلكترونية، حيث تعمل كوسيط تقني يربط العملاء بشركات الشحن المعتمدة في المملكة العربية السعودية. تتيح المنصة للمتاجر الإلكترونية وأصحاب المشاريع إمكانية اختيار شركات الشحن المناسبة وإصدار بوالص الشحن بسهولة من خلال التكامل التقني المباشر مع شركات الشحن مثل: (سمسا، أرامكس، جي آند تي، شركات شحن أخرى قد تُضاف لاحقًا).

توفر منصة بوليصات العديد من المميزات للعملاء، من ذلك على سبيل المثال:
التكامل المباشر مع شركات الشحن: حيث يتم إصدار البوالص مباشرة من النظام المعتمد لدى كل شركة شحن.
إظهار السعر النهائي قبل الإصدار: لا يتم فرض أي رسوم إضافية بعد إتمام الإصدار، ويتم اقتطاع المبلغ المحدد مسبقًا من محفظة العميل الإلكترونية.
سهولة تتبع الشحنات: يتيح النظام تتبع حالة البوالص الصادرة عبر واجهة المستخدم الخاصة بالعميل.
إدارة مركزية للشحنات: يمكن للمتاجر إدارة جميع شحناتها من مكان واحد، مما يوفر الوقت والجهد.
إمكانية ربط المتجر الإلكتروني: توفر المنصة خيارات التكامل التقني API لتمكين المتاجر من إصدار البوالص تلقائيًا عند إتمام عمليات البيع.
آلية عمل بوليصات:
يُمكن للعميل الاستفادة من خدمات بوليصات من خلال الخطوات التالية:
إنشاء حساب على المنصة وتقديم المعلومات المطلوبة بشكل صحيح.
شحن المحفظة الإلكترونية بمبلغ كافٍ لتغطية رسوم البوالص المطلوبة.
اختيار شركة الشحن المناسبة بناءً على الأسعار والخدمات المتاحة.
إدخال تفاصيل الشحنة، مثل: (عنوان المرسل والمستلم، أبعاد ووزن الشحنة، أي ملاحظات أو خدمات إضافية متاحة من شركة الشحن).
إتمام الدفع وإصدار بوليصة الشحن إلكترونيًا.
طباعة البوليصة وإرفاقها مع الشحنة قبل تسليمها لشركة الشحن المختارة.
3 الأهلية
الأهلية القانونية:
تقدم منصة بوليصات خدماتها فقط للأشخاص الذين يتمتعون بالأهلية القانونية الكاملة للدخول في المعاملات القانونية. لذا، يجب أن يكون المستخدمون والعملاء مؤهلين قانونيًا لإجراء التصرفات القانونية عبر المنصة والدخول كأطراف في العقود التي يشاركون فيها.
أهلية الشركات:
لاستخدام بوليصات والاستفادة من خدماتها، يجب أن تكون الشركة أو المتجر الإلكتروني مسجلًا بشكل قانوني في المملكة العربية السعودية، ويمتلك سجلًا تجاريًا ساري المفعول (إن كان ذلك مطلوبًا حسب النشاط التجاري). وكذلك يجب أن تلتزم جميع المتاجر والشركات بالقوانين والأنظمة المعمول بها في المملكة العربية السعودية، بما في ذلك أنظمة الهيئة العامة للنقل المتعلقة بالشحن والخدمات اللوجستية.
الحد الأدنى للسن:
يجب أن يكون العميل الذي يطلب أي من خدماتنا من خلال منصة بوليصات قد أتم 18 عامًا أو بلغ السن القانوني المحدد بموجب الأنظمة السارية في المملكة العربية السعودية، ويجب أن يكون لديه القدرة على التمييز والإدراك الكامل لجميع تصرفاته القانونية.
القصر والإشراف:
في حال كان أحد مستخدمي منصة بوليصات دون سن 18 عامًا أو لم يبلغ السن القانوني المعمول به في المملكة العربية السعودية، يجب عليه استخدام خدمات المنصة تحت إشراف أحد الوالدين أو الوصي القانوني. يتحمل الوالد أو الولي الجبري أو الوصي المسؤولية الكاملة عن جميع النتائج المترتبة على استخدام القاصر للخدمات.
إقرار المستخدم:
يقر المستخدم في جميع الحالات بأنه مؤهل قانونيًا لاستخدام خدمات منصة بوليصات، وأن هذا الإقرار يتم على مسؤوليته الشخصية، دون أن تتحمل منصة بوليصات أو مشغليها أي مسؤولية قانونية.
4 الأنظمة السعودية المطبقة
أنظمة الهيئة العامة للنقل:
تلتزم جميع خدمات الشحن الصادرة عبر المنصة بالأنظمة واللوائح الصادرة عن الهيئة العامة للنقل السعودي، بما في ذلك القواعد المتعلقة بشحن البضائع، وضوابط النقل، ومعايير التعبئة والتغليف، والأوزان المسموح بها. لا يُسمح باستخدام المنصة لإصدار بوالص لشحن مواد محظورة وفقًا لأنظمة الهيئة العامة للنقل أو سياسات شركات الشحن.
نظام التجارة الإلكترونية (الصادر بالمرسوم الملكي رقم م/126 بتاريخ 1440/11/07هـ):
نظرًا لأن بوليصات تعمل كمنصة إلكترونية، فهي تلتزم بجميع أحكام نظام التجارة الإلكترونية في المملكة العربية السعودية، بما في ذلك الشفافية في عرض الخدمات والأسعار، والالتزام بحماية بيانات العملاء. ويتم الإفصاح بوضوح عن جميع الرسوم والأسعار النهائية قبل إتمام أي معاملة.
نظام مكافحة الجرائم المعلوماتية (الصادر بالمرسوم الملكي رقم م/17 بتاريخ 1428/3/8هـ):
تحظر بوليصات أي استخدام غير قانوني للمنصة، مثل إدخال بيانات وهمية أو احتيالية، أو إساءة استخدام النظام الإلكتروني بأي شكل قد يؤدي إلى الإضرار بالمنصة أو الأطراف الأخرى.
نظام حماية البيانات الشخصية (الصادر بالمرسوم الملكي رقم م/19 بتاريخ 1443/2/9هـ):
تلتزم بوليصات بحماية بيانات العملاء والمتاجر والشركات، وعدم استخدامها أو مشاركتها مع أي طرف خارجي إلا وفقًا لما تقضي به الأنظمة السعودية أو بموجب طلب رسمي من الجهات المختصة. ويتم استخدام بيانات العملاء فقط لغرض تقديم وتحسين الخدمات وفقًا لسياسة الخصوصية المعتمدة.
نظام مكافحة الغش التجاري (الصادر بالمرسوم الملكي رقم م/19 بتاريخ 1429/4/23هـ):
يحظر على أي عميل أو متجر استخدام المنصة في إصدار بوالص لشحن منتجات مقلدة أو مزيفة أو غير مطابقة للمواصفات، ويكون العميل مسؤولًا بشكل كامل عن دقة وصحة المنتجات المشحونة عبر المنصة.
الامتثال لشروط شركات الشحن:
بالإضافة إلى الالتزام بالأنظمة السعودية، يجب على جميع مستخدمي بوليصات الالتزام بالشروط والسياسات الخاصة بشركات الشحن المتعاقدة، والتي قد تتضمن:
سياسات الأوزان والأبعاد لكل شركة شحن.
قواعد التعبئة والتغليف المطلوبة لضمان سلامة الشحنات أثناء النقل.
قوائم المواد المحظورة التي لا يمكن شحنها.
الامتثال للطلبات الحكومية والقضائية:
تحتفظ بوليصات بحقها في الامتثال لأي أوامر حكومية أو قضائية تتطلب تقديم معلومات حول العملاء أو العمليات التي تتم عبر المنصة، وذلك وفقًا لما تسمح به الأنظمة السعودية المعمول بها.
5 سياسة الحساب
إنشاء الحساب:
يتعين على المستخدم تسجيل حساب شخصي على منصة بوليصات للاستفادة من خدماتنا. يشمل ذلك تقديم معلومات صحيحة وكاملة عند التسجيل. ويتعهد المستخدم بتحديث بياناته الشخصية إذا طرأت أي تغييرات، وذلك للحفاظ على دقة الحساب.
متطلبات التسجيل:
يتعين على المستخدم تقديم البيانات المطلوبة في استمارة التسجيل بدقة وشفافية، بالإضافة إلى أي معلومات إضافية قد تطلبها إدارة المنصة لتفعيل الحساب أو استكمال عملية التسجيل.
صحة المعلومات:
يتحمل المستخدم مسؤولية تقديم معلومات دقيقة وكاملة عند التسجيل. لا يتحمل منصة بوليصات أي مسؤولية قانونية عن الأخطاء أو البيانات غير الصحيحة المقدمة من المستخدم.
أمان الحساب:
يجب على المستخدم اختيار كلمة مرور آمنة عند إنشاء الحساب والحفاظ على سرية كلمة المرور. ويتحمل المستخدم المسؤولية الكاملة عن أي نشاط يحدث في حسابه. ويُنصح المستخدم بعدم مشاركة تفاصيل الحساب أو كلمة المرور مع أي طرف آخر. وفي حالة الاشتباه في أي اختراق أو استخدام غير مصرح به للحساب، يتعين على المستخدم إشعار منصة بوليصات فورًا لاتخاذ الإجراءات اللازمة.
استخدام الحساب:
يُرخص للمستخدم باستخدام حسابه في منصة بوليصات فقط لأغراض قانونية ومتوافقة مع الشروط والأحكام. ويتحمل المستخدم المسؤولية الكاملة عن جميع الأنشطة التي تتم باستخدام حسابه.
إغلاق الحساب:
يستطيع المستخدم إغلاق حسابه في أي وقت عبر إرسال طلب رسمي إلى منصة بوليصات. سيتم إغلاق الحساب بعد معالجة الطلب. وفي حالة الإغلاق، يتحمل المستخدم مسؤولية أي معاملة قيد الانتظار أو لم يتم تنفيذها بعد إغلاق الحساب.
إلغاء الحساب:
تحتفظ منصة بوليصات بحقها في إلغاء أو تعليق الحسابات في حال ارتكب المستخدم أي مخالفة للشروط والأحكام أو قام باستخدام الحساب لأغراض غير قانونية أو خرق لسياسة المنصة. وفي حالة الإلغاء، يتم إخطار المستخدم بالإجراء المتخذ وتوضيح السبب وراء إلغاء الحساب.
الخصوصية وحماية البيانات:
يتم التعامل مع جميع البيانات الشخصية المقدمة من قبل المستخدم وفقًا لسياسة الخصوصية المعتمدة من قبل منصة بوليصات. ويوافق المستخدم على جمع واستخدام بياناته الشخصية وفقًا للغرض الذي تم توفيرها من أجله فقط، ويحق له تعديل بياناته في أي وقت من خلال حسابه.
مسؤولية الحساب:
يظل المستخدم مسؤولًا عن أي نشاط يتم من خلال حسابه، سواء كان المستخدم هو من قام بذلك النشاط أو شخص آخر حصل على إذن باستخدام الحساب. وفي حال حدوث أي خرق أو أضرار بسبب استخدام غير مصرح به، يلتزم المستخدم بتعويض منصة بوليصات عن أي خسائر أو أضرار قد تنجم عن ذلك.
ترخيص الحساب:
تُقدَّم خدمة الحساب في منصة بوليصات بموجب ترخيص استخدام. ويحق لإدارة المنصة سحب هذا الترخيص أو إيقاف الحساب أو إنهاء استخدامه في أي وقت ودون الحاجة إلى تقديم أسباب.
6 سياسة تسعير الخدمات
تحديد الأسعار:
يتم تحديد أسعار بوالص الشحن بناءً على الأسعار المتفق عليها مسبقًا بين بوليصات وشركات الشحن المتكاملة مع المنصة، مثل سمسا، أرامكس، وJ&T، وذلك على النحو الآتي:
توفر منصة بوليصات أسعارًا تنافسية لبوالص الشحن، حيث تبدأ الأسعار من 28 ريال سعودي.
يتم عرض السعر النهائي للبوليصة بشكل واضح للعميل قبل الدفع بحيث يكون العميل على دراية كاملة بالتكلفة قبل إتمام المعاملة، حيث لا يمكن إلغاء أو تعديل البوليصة بعد إصدارها. ويلتزم العميل بدفع كافة تكاليف ورسوم بوليصة الشحن مسبقًا قبل إتمام إصدارها.
جميع الأسعار قابلة للتغيير وفقًا لسياسات التسعير الخاصة بشركات الشحن أو تحديثات منصة بوليصات، فتعتمد تكلفة الشحن على شركة الشحن المختارة، الوزن الفعلي أو الحجمي (أيهما أكبر)، الوجهة، وأي رسوم إضافية تُطبق من قبل شركة الشحن.
تشمل الأسعار جميع الرسوم المتعلقة بعملية الشحن وفقًا لما تحدده شركات الشحن، مع إمكانية إضافة خدمات اختيارية قد تؤدي إلى رسوم إضافية.
الرسوم الإضافية:
لا تفرض بوليصات أي رسوم خفية، ويكون العميل على اطلاع بكامل التكلفة قبل الدفع. وقد يتم تطبيق رسوم إضافية في حالة اختيار خدمات خاصة تقدمها شركات الشحن، مثل الشحن السريع أو خدمات التوصيل الخاصة، وفقًا لما تحدده شركة الشحن. ولا توجد رسوم تأمين افتراضية، حيث أن بوليصات لا تقدم خدمات التأمين على الشحنات، وإنما يخضع ذلك للسياسات الداخلية لشركات الشحن المتكاملة مع المنصة.
الرسوم الحكومية:
جميع الأسعار المعلنة على المنصة تشمل الرسوم المقررة وفقًا لأنظمة المملكة العربية السعودية. وفي حالة فرض أي رسوم جديدة من قبل الجهات التنظيمية المختصة، تحتفظ بوليصات بحقها في تعديل الأسعار لتعكس تلك التغييرات.
الضريبة المضافة:
جميع الأسعار المعلنة لا تشمل ضريبة القيمة المضافة، التي ستضاف إلى الفاتورة النهائية وفقًا للقوانين السارية. قد تخضع الأسعار المعلنة لضرائب أو رسوم إضافية، ويتحمل العميل مسؤولية سداد أي التزامات ضريبية جديدة يتم فرضها بعد تاريخ الحجز.
التحديثات على التسعير:
تحتفظ بوليصات بحقها في تعديل سياسة التسعير وفقًا لأي تغييرات في تكاليف الشحن أو رسوم شركات الشحن المتعاقدة. وسيتم إخطار المستخدمين بأي تغييرات جوهرية في الأسعار في حال وجود تعذر تسليم أي طلبات قائمة، وذلك عبر وسائل الاتصال المعتمدة من المنصة.
تُعتبر سياسة التسعير هذه جزءًا لا يتجزأ من الاتفاقية العامة بين منصة بوليصات والعميل، ويُعد العميل موافقًا على سياسة التسعير بمجرد إتمام الحجز أو الدفع. وفي حال وجود أي نزاع بشأن الأسعار أو المدفوعات، يتم الرجوع إلى إدارة المنصة للتسوية.
7 سياسة العروض والتخفيضات
صلاحية العروض والتخفيضات:
جميع العروض والتخفيضات التي تقدمها منصة بوليصات تكون محدودة بمدة زمنية معينة، ويتم الإعلان عن شروطها بوضوح قبل تفعيلها. وتخضع العروض لشروط وأحكام خاصة يتم تحديدها لكل عرض على حدة، ويجب على العملاء مراجعة تفاصيل العرض قبل الاستفادة منه. وتحتفظ بوليصات بحقها في تعديل أو إلغاء أي عرض أو تخفيض دون إشعار مسبق، إذا دعت الحاجة لذلك.
آلية الاستفادة من العروض:
يتم تقديم العروض إما على شكل خصومات مباشرة على أسعار بوالص الشحن، أو من خلال قسائم أو أكواد خصم يمكن للمستخدم إدخالها عند الدفع. وبعض العروض قد تكون مخصصة لفئات معينة من العملاء، مثل المستخدمين الجدد أو المتاجر الكبيرة، وفقًا للشروط المعلنة. ولا يمكن الجمع بين أكثر من عرض أو تخفيض في معاملة واحدة، ما لم يتم النص على ذلك صراحةً في شروط العرض.
الاستخدام العادل للعروض:
لا يجوز للمستخدم استغلال العروض بطرق غير قانونية أو احتيالية، مثل إنشاء حسابات متعددة للاستفادة من نفس العرض عدة مرات. وتحتفظ بوليصات بحقها في إلغاء أي خصم أو عرض تم استغلاله بطرق غير قانونية، وقد يؤدي ذلك إلى تعليق حساب المستخدم في حالة تكرار المخالفة.
استرداد قيمة العروض:
في حال تم إلغاء بوليصة شحن أو لم يتم استخدامها خلال المدة المحددة (7 أيام)، فإن قيمة الخصم المستخدم في البوليصة لا يمكن استردادها أو تعويضها. وإذا كان العرض يتضمن رصيدًا إضافيًا في المحفظة الإلكترونية، فلا يمكن تحويل هذا الرصيد إلى أموال نقدية أو استرداده بأي وسيلة أخرى.
8 سياسة الحجز
عملية الحجز وإصدار البوالص:
يمكن للعملاء حجز وإصدار بوالص الشحن من خلال منصة بوليصات بعد إتمام تسجيل الدخول إلى الحساب وشحن المحفظة الإلكترونية بالرصيد الكافي. وعند اختيار شركة الشحن وإدخال تفاصيل الشحنة، يتم عرض السعر النهائي للبوليصة قبل إتمام الإصدار، ولا يمكن تعديله بعد ذلك. وبمجرد تأكيد الحجز، يتم إصدار البوليصة فورًا وإرسالها إلى العميل عبر البريد الإلكتروني أو من خلال حسابه في المنصة.
صلاحية البوليصة:
جميع بوالص الشحن المصدرة صالحة لمدة 7 أيام من تاريخ الإصدار، ويجب استخدامها خلال هذه الفترة. وفي حال عدم استخدام البوليصة خلال المدة المحددة، تُعتبر غير صالحة ولا يمكن استرجاع قيمتها.
إدخال ومراجعة البيانات:
يلتزم العميل بإدخال بيانات الشحنة بشكل دقيق وصحيح قبل إصدار البوليصة، ويتحمل العميل كافة النتائج الناشئة عن الإدخال غير الصحيح للبيانات.
قيود الحجز:
يحق لمنصة بوليصات فرض حدود على عدد البوالص التي يمكن للعميل حجزها يوميًا أو شهريًا، وذلك لضمان الاستخدام العادل للخدمة. وتحتفظ المنصة بحقها في رفض أي حجز في حال الاشتباه بوجود نشاط غير قانوني أو احتيالي. علمًا بأن بعض شركات الشحن قد تضع قيودًا على أنواع البضائع أو الوجهات المدعومة، ويجب على العميل الاطلاع على الشروط الخاصة بشركة الشحن المختارة قبل الحجز.
التعديلات على الحجز:
بمجرد إصدار البوليصة، لا يمكن تعديل تفاصيلها (مثل تغيير العنوان، الوزن، أو المحتوى). وفي حال وجود خطأ في إدخال البيانات، يمكن للعميل إصدار بوليصة جديدة مع البيانات الصحيحة، ولكن لن يتم استرداد المبلغ المدفوع عن البوليصة السابقة.
تأكيد الحجز والإشعارات:
بمجرد إتمام الحجز، يتم إرسال تأكيد عبر البريد الإلكتروني أو الإشعارات داخل المنصة، متضمنًا تفاصيل البوليصة ورقم التتبع إن وجد. وفي بعض الحالات، قد يتطلب الحجز إجراءات تحقق إضافية من العميل لضمان صحة البيانات المقدمة، مما قد يؤخر عملية الإصدار.
الإلغاء التلقائي للحجوزات غير المدفوعة:
في حال عدم توفر رصيد كافٍ في محفظة العميل، لن يتمكن من إتمام الحجز، ويجب عليه شحن المحفظة أولًا. وإذا لم يقم العميل بإتمام عملية الدفع خلال فترة زمنية معينة، قد يتم إلغاء الحجز تلقائيًا.
حالات القوة القاهرة:
في حال حدوث ظروف استثنائية مثل الكوارث الطبيعية أو المشكلات التقنية التي تؤدي إلى فشل الحجز أو عدم إمكانية استخدام البوليصة، ستقوم بوليصات بدراسة كل حالة على حدة وإيجاد حلول مناسبة، دون أن يكون ذلك التزامًا قانونيًا برد المبلغ المدفوع.
عند الحجز، يوافق العميل على الشروط والأحكام الخاصة بشركة الشحن المختارة، بما في ذلك الأوزان المسموحة، الأبعاد، والمحظورات. ويُنصح العميل بمراجعة تفاصيل الحجز قبل إتمامه، حيث لا يمكن إجراء تعديلات بعد الإصدار.
9 سياسة الإلغاء
عدم قابلية الإلغاء:
بمجرد إصدار بوليصة الشحن عبر المنصة، لا يمكن إلغاؤها أو تعديلها أو استرداد قيمتها، حيث تتم معالجة البيانات مباشرة لدى شركة الشحن المختارة. ويلتزم العميل بالتحقق من جميع تفاصيل الشحنة والسعر قبل إتمام الحجز، حيث لا يُسمح بإلغاء البوالص لأي سبب بعد إصدارها.
انتهاء صلاحية البوليصة:
جميع البوالص المصدرة صالحة لمدة 7 أيام من تاريخ إصدارها، ويجب على العميل استخدامها خلال هذه الفترة. وفي حال عدم استخدام البوليصة خلال مدة صلاحيتها، لن يكون هناك أي تمديد للصلاحية أو تعويض أو استرداد للمبلغ المدفوع، ويُعد ذلك مسؤولية العميل بالكامل.
الإلغاء بسبب خطأ في الإصدار:
في حال وجود خطأ تقني في إصدار البوليصة أو كان هناك خطأ من قبل المنصة أدى إلى إصدار بوليصة شحن غير صحيحة، يمكن للعميل التواصل مع دعم منصة بوليصات خلال 24 ساعة من الإصدار للنظر في إمكانية معالجة المشكلة وفقًا لكل حالة. علمًا بأن المنصة لا تتحمل بوليصات أي مسؤولية عن الأخطاء الناتجة عن إدخال العميل لبيانات غير صحيحة أو غير مكتملة.
الإلغاء بسبب خطأ التسعير:
في حال وجود خلل في تسعير البوالص ناتج عن خطأ تقني أو مشكلة في التكامل مع شركات الشحن، يحق لمنصة بوليصات إلغاء البوليصة وإعادة المبلغ إلى محفظة العميل. ولا تتحمل بوليصات أي مسؤولية عن أي خسائر أو تكاليف إضافية يتكبدها العميل بسبب إلغاء البوليصة لأي سبب مشروع.
الإلغاء بسبب مشكلات الدفع:
إذا قام العميل بمحاولة إصدار بوليصة ولم يتمكن من الدفع بسبب رصيد غير كافٍ في محفظته الإلكترونية، لن يتم إتمام الإصدار، ولن يتم حجز البوليصة حتى يتم إضافة الرصيد وإعادة محاولة الإصدار. وأي حجوزات لم يتم استكمالها لن يتم الاحتفاظ بها، وقد يتم إلغاؤها تلقائيًا دون أي التزام من بوليصات.
الإلغاء من قبل بوليصات:
تحتفظ بوليصات بالحق في إلغاء أي بوليصة صادرة في الحالات التالية:
إذا تبين أن المعلومات المقدمة من العميل غير صحيحة أو مضللة.
في حال الاشتباه بوجود احتيال أو إساءة استخدام للخدمة.
إذا قامت شركة الشحن المختارة برفض معالجة الشحنة لأي سبب مشروع وفقًا لسياساتها الداخلية.
في حال عدم الامتثال للأنظمة السعودية أو عند محاولة شحن عناصر ممنوعة بموجب القانون أو لائحة الهيئة العامة للنقل.
في حال قامت بوليصات بإلغاء البوليصة لأي من الأسباب المذكورة، لن يكون العميل مؤهلاً لاسترداد أي مبالغ مدفوعة.
إشعارات الإلغاء:
يتم إخطار العملاء بسياسة الإلغاء بشكل واضح قبل إتمام عملية الدفع والإصدار. وفي حال وجود تغييرات على سياسة الإلغاء بالنسبة للطلبات القائمة، سيتم إشعار العملاء بها من خلال الوسائل الرسمية المعتمدة من بوليصات.
10 سياسة الشحن
دور المنصة في عملية الشحن:
تعمل بوليصات كوسيط رقمي يربط العملاء بشركات الشحن المعتمدة في المملكة العربية السعودية، وبالتالي فإن جميع عمليات الشحن تتم عبر شركات الشحن المتعاقدة، وتخضع لشروطها وسياساتها الداخلية، ويوافق العميل على الامتثال لهذه الشروط عند اختيار أي شركة شحن عبر المنصة. علمًا بأن المنصة لا تقوم بتنفيذ عمليات الشحن بنفسها، وبالتالي فإن مسؤولية التوصيل، المدة، الحالات الخاصة، والتأخير تقع على عاتق شركة الشحن المختارة.
نطاق الخدمة:
يقتصر نطاق خدمات بوليصات على الشحن داخل المملكة العربية السعودية فقط. ولا توفر المنصة حاليًا خدمات الشحن الدولي أو الشحن إلى وجهات خارج نطاق التغطية المحدد من قبل شركات الشحن المتاحة.
عنوان الشحن:
يخضع عنوان الشحن الذي تزودنا به للأحكام الآتية:
يجب أن يتضمن العنوان (اسم المستلم بالكامل، رقم الهاتف الصحيح وقابل للتواصل، تفاصيل العنوان بدقة "رقم المبنى، اسم الشارع، المدينة، الرمز البريدي، أي تفاصيل إضافية"، أي تعليمات خاصة قد تسهل عملية التسليم).
يتحمل العميل مسؤولية إدخال عنوان الشحن الصحيح والكامل عند إصدار بوليصة الشحن عبر منصة بوليصات. علمًا بأن أي خطأ أو نقص في العنوان قد يؤدي إلى تأخير الشحنة أو إرجاعها، ويتحمل العميل أي تكاليف إضافية ناتجة عن ذلك.
لا يمكن تعديل العنوان بعد إصدار البوليصة، حيث تعتمد شركات الشحن على البيانات المدخلة وقت الإصدار. وفي حال اكتشاف العميل خطأً في العنوان بعد إصدار البوليصة، يمكنه محاولة التواصل مع شركة الشحن مباشرة لمحاولة تصحيح العنوان وفقًا لسياساتها.
في حال عدم تمكن شركة الشحن من تسليم الشحنة بسبب عنوان غير صحيح، أو عدم استجابة المستلم، قد يتم اتخاذ أحد الإجراءات التالية: (إعادة الشحنة إلى المرسل مع تحميل العميل تكاليف الإرجاع والتخزين، أو فرض رسوم إضافية لإعادة توصيل الشحنة في حال توفر هذه الخدمة من قبل شركة الشحن، أو إلغاء البوليصة دون أي استرداد للمبلغ المدفوع إذا لم يتم حل المشكلة خلال المدة المحددة من قبل شركة الشحن).
بعض شركات الشحن قد لا تغطي مناطق معينة داخل المملكة العربية السعودية، مثل: (المناطق النائية أو الصحراوية، أو المواقع التي لا يوجد بها عناوين واضحة أو رموز بريدية محددة)، وفي هذه الحالات، يجب على العميل اختيار أقرب نقطة استلام متاحة أو التواصل مع شركة الشحن لمعرفة الخيارات البديلة.
مدة الشحن:
تختلف مدة الشحن وفقًا لشركة الشحن المختارة، نوع الخدمة، والوجهة. وتخضع مدة الشحن للأحكام الآتية:
تكون المدة القياسية المتوقعة للتوصيل داخل المملكة العربية السعودية تتراوح بين (1-5) أيام عمل، لكنها قد تتغير وفقًا لظروف التشغيل الخاصة بشركات الشحن.
لا تضمن بوليصات تسليم الشحنات خلال مدة محددة، حيث تعتمد المدة الفعلية على شروط وأحكام كل شركة شحن.
قد تواجه شركات الشحن تأخيرات في التوصيل خلال المواسم المزدحمة مثل رمضان، الأعياد، والمناسبات الخاصة. وفي حال وجود أي إشعارات رسمية من شركات الشحن حول تأخيرات متوقعة، سيتم إخطار العملاء بذلك عبر المنصة أو البريد الإلكتروني.
قد تستغرق الشحنات الموجهة إلى المناطق البعيدة أو التي تغطيها شركات الشحن بشكل محدود وقتًا أطول من المدة القياسية. وقد تفرض بعض شركات الشحن رسومًا إضافية أو جداول زمنية خاصة لهذه المناطق، وعلى العميل مراجعة التفاصيل قبل إتمام الطلب.
تبدأ مدة الشحن من تاريخ استلام الشحنة من قبل شركة الشحن وليس من تاريخ إصدار البوليصة. وبعض شركات الشحن قد يكون لديها مواعيد استلام يومية محددة، مما قد يؤثر على موعد بدء الشحن.
تتبع الشحنات:
توفر بوليصات رابط تتبع لكل بوليصة شحن صادرة، ويمكن للعملاء متابعة حالة شحناتهم عبر نظام التتبع الخاص بشركة الشحن المختارة عن طريق إدخال رقم الشحنة واسم شركة الشحن. ولا تتحمل بوليصات مسؤولية دقة أو تحديثات معلومات التتبع، حيث تعتمد هذه المعلومات على بيانات شركات الشحن.
التأخير في الشحن والمسؤولية:
منصة بوليصات ليست مسؤولة عن أي تأخير في التسليم ناتج عن عوامل خارج سيطرتها، مثل: (الظروف الجوية القاسية، والازدحام الموسمي أو زيادة الطلب على الشحن، والإجراءات الجمركية أو التنظيمية التي قد تؤثر على بعض الشحنات، والأخطاء في عنوان العميل أو عدم استلام الشحنة من قبله). ويتحمل العميل مسؤولية التواصل مع شركة الشحن المختارة في حال حدوث أي تأخير غير متوقع.
فشل التسليم وعدم الاستلام:
في حال عدم استلام العميل للشحنة خلال المدة المحددة من قبل شركة الشحن، قد يتم تطبيق أحد الإجراءات التالية:
إعادة الشحنة إلى المرسل، مع خصم أي رسوم إعادة أو تخزين.
فرض رسوم إضافية في حال تأخر العميل في استلام الشحنة من نقاط الاستلام الخاصة بشركة الشحن.
إلغاء البوليصة دون أي استرداد للمبلغ المدفوع في حال انتهاء المدة القصوى للاحتفاظ بالشحنة.
حالات القوة القاهرة:
لن تكون بوليصات مسؤولة عن أي تعويضات أو استرداد مع احتفاظ المنصة بحقها في تعليق أو تأخير أو إلغاء عمليات الشحن المتأثرة وفقًا لما تراه مناسبًا، مع التزام العميل بمتابعة شركات الشحن مباشرة، وذلك في حال وقوع أحداث خارجة عن السيطرة، مثل:
الكوارث الطبيعية (السيول، العواصف، الزلازل).
القرارات الحكومية التي تؤثر على عمليات الشحن.
الأوبئة أو الأزمات الصحية العامة.
الظروف الأمنية الطارئة.
11 محظورات الشحن
المواد المحظورة قانونًا:
أي مواد غير مشروعة أو محظورة بموجب قوانين المملكة العربية السعودية أو قوانين الدول التي يتم الشحن إليها، بما في ذلك:
المخدرات والمسكرات وجميع مذهبات العقل والمواد الكيميائية الخطرة.
الأسلحة النارية والذخائر والمتفجرات بجميع أشكالها والمواد القابلة للاشتعال.
المواد الإشعاعية أو البيولوجية أو النووية.
العملات المزورة أو الأدوات المستخدمة في التزوير.
الحيوانات والمنتجات الحيوانية المحظورة.
المواد التي تتطلب موافقات خاصة:
بعض المواد لا يمكن شحنها إلا بعد الحصول على تصاريح رسمية من الجهات المختصة، ومنها:
المنتجات الطبية والأدوية.
المواد الكيميائية الصناعية.
الأجهزة الإلكترونية المشعة أو التي تعمل بتقنيات لاسلكية معينة.
المواد الخطرة أو القابلة للتلف:
وتشمل المواد التي تشكل خطرًا أثناء النقل، بما في ذلك:
الغازات المضغوطة والمواد القابلة للاشتعال.
البطاريات عالية السعة التي قد تتسبب في اشتعال أو انفجار.
المواد السامة أو المسببة للتآكل.
الأغذية القابلة للتلف أو المنتجات التي تتطلب درجات حرارة معينة للحفاظ عليها.
المواد المحظورة من قبل شركات الشحن:
تخضع الشحنات أيضًا لسياسات شركات الشحن المتعاقد معها (مثل سمسا، أرامكس، J&T)، وقد يتم رفض شحن بعض المواد بناءً على سياساتهم الخاصة. ويتعين على العميل مراجعة سياسات شركة الشحن المختارة قبل إصدار البوليصة للتأكد من مطابقة الشحنة للشروط المطلوبة.
القيود العامة على الشحن:
تفرض منصة بوليصات قيودًا عامة على الشحن، على النحو التالي:
يُحظر شحن المنتجات أو المعدات الثقيلة جدًا أو التي تتجاوز أبعادها 50 سم حجميًا أو وزنها 25 كيلوجرامًا.
يُحظر شحن حقائب السفر بكافة أنواعها، ما لم تكن بتغليف المصنع وفارغة تمامًا.
يُحظر شحن الأدوية الحساسة للحرارة، بغض النظر عن نوعها.
يُحظر شحن بطاقات الهوية، الإثباتات الشخصية، أو أي مستندات قد تضر بمصالح الأطراف.
يُحظر شحن الطرود بين نفس المرسل والمستلم أو بين أفراد العائلة الواحدة.
يُحظر شحن العملات النقدية، الصكوك، السندات، والسبائك
يُحظر شحن الآثار التي تندرج تحت نظام الآثار والمتاحف والتراث العمراني.
12 التفتيش والمصادرة
التفتيش الأمني للشحنات:
تحتفظ شركات الشحن المتعاقدة عبر منصة بوليصات بالحق في فتح وفحص أي شحنة لضمان الامتثال للوائح والقوانين المعمول بها في المملكة العربية السعودية، وكذلك للتأكد من عدم احتواء الشحنة على أي مواد محظورة أو خطرة. ويتم التفتيش وفقًا للأنظمة المعتمدة من الهيئة العامة للنقل السعودي، وبما يتوافق مع سياسات كل شركة شحن شريكة. ولا تتحمل بوليصات أي مسؤولية عن أي ضرر قد يلحق بالشحنة نتيجة عمليات التفتيش الأمني من قبل شركات الشحن أو الجهات المختصة.
الحالات التي تستوجب التفتيش والمصادرة:
يحق لشركة الشحن، بناءً على توجيهات الجهات المختصة، فتح الطرد وفحص محتوياته في الحالات التالية:
إذا اشتُبه في أن الشحنة تحتوي على مواد محظورة أو مقيدة بموجب أنظمة المملكة العربية السعودية.
إذا تطلب الأمر ذلك وفقًا لسياسات التفتيش العشوائي أو إجراءات الأمان المتبعة.
بناءً على طلب رسمي من الجهات الأمنية أو الجهات التنظيمية المختصة.
عند الاشتباه في تقديم العميل بيانات غير صحيحة أو مضللة حول محتوى الشحنة.
مصادرة الشحنات المخالفة:
في حال اكتشاف مواد محظورة أو غير قانونية داخل الشحنة، سيتم اتخاذ الإجراءات التالية:
إبلاغ الجهات المختصة لاتخاذ الإجراءات القانونية المناسبة.
مصادرة الشحنة بالكامل دون أي تعويض للمرسل أو المستلم.
إدراج المرسل في قائمة الحظر إذا تكررت المخالفات أو ثبت تعمد إرسال مواد غير قانونية.
13 سياسة الأوزان والأبعاد
الالتزام بالمعايير المعتمدة:
يتم احتساب أوزان الشحنات وفقًا للتسعيرات الموضحة في منصة بوليصات، وذلك إما بناءً على الوزن الفعلي أو الوزن الحجمي، أيهما أكبر. ويتحمل العميل مسؤولية إدخال الوزن والأبعاد بدقة، حيث أن أي خطأ في هذه البيانات قد يؤدي إلى رسوم إضافية أو رفض الشحنة من قبل شركة الشحن.
آلية احتساب الوزن الحجمي والفوترة:
الوزن الفعلي: هو الوزن الحقيقي للشحنة بالكيلوجرام.
الوزن الحجمي: يتم حسابه وفقًا لأبعاد الشحنة، ويمكن حسابه من خلال حاسبة الوزن الحجمي الخاصة بمنصة بوليصات.
يتم احتساب رسوم الشحن بناءً على الوزن الأعلى بين الوزن الفعلي والوزن الحجمي.
إذا تجاوزت الشحنة الوزن الأساسي المحدد في التسعيرة، يتم احتساب رسوم إضافية على الوزن الزائد.

يتم حساب الوزن الحجمي باستخدام المعادلة التالية:

ملاحظة: تختلف قيمة القسمة (4000) بناءً على سياسات شركات الشحن، ويُنصح بالتحقق من اللوائح المحددة لكل شركة.
سياسة الوزن الزائد:
إذا تجاوزت الشحنة الوزن الأساسي المحدد في التسعيرة (مثلاً 10 كجم للطرد الواحد)، يتم فرض رسوم إضافية بقيمة (3) ريال لكل كيلوغرام زائد. ويتم تحصيل أي رسوم إضافية من رصيد المحفظة الإلكترونية للعميل، وفي حال عدم كفاية الرصيد، يلتزم العميل بتسديد المبلغ قبل إتمام الشحن.
الحدود القصوى للأوزان والأبعاد:
تختلف الحدود القصوى بناءً على شركة الشحن المختارة، لذا يجب على العميل مراجعة الحدود القصوى لكل شركة شحن. علمًا بأنه إذا تجاوزت الشحنة هذه الحدود القصوى، قد يتم فرض رسوم إضافية أو رفض الشحنة من قبل شركة الشحن.
الشحنات ذات الأحجام غير القياسية:
في حال كانت الشحنة ذات أحجام غير قياسية أو أبعاد غير متناسقة، قد يتم فرض رسوم إضافية بسبب الحاجة إلى معالجة خاصة. وتشمل الشحنات غير القياسية الطرد غير المكعب، الشحنات المستديرة، الأنابيب الطويلة، إلخ.
مسؤولية العميل في صحة البيانات:
يتحمل العميل مسؤولية إدخال بيانات الوزن والأبعاد بدقة عند إصدار بوليصة الشحن، وأي خطأ في البيانات قد يؤدي إلى:
رفض الشحنة من قبل شركة الشحن.
إعادة حساب تكلفة الشحن وفرض رسوم إضافية عند استلام شركة الشحن للشحنة الفعلية.
تأخير في معالجة الشحنة حتى يتم دفع الفروقات في السعر أو تعديل البيانات.
مراجعة وتعديل بيانات الشحن:
تحتفظ شركات الشحن بحق إعادة قياس الشحنات عند استلامها، وإذا تبين وجود فرق بين الوزن أو الأبعاد المدخلة والبيانات الفعلية، يتم تعديل السعر وفقًا للوزن الحجمي الحقيقي. ويحق لمنصة بوليصات تحصيل أي رسوم إضافية نتيجة هذه التعديلات من رصيد المحفظة الإلكترونية للعميل، وفي حال عدم كفاية الرصيد، يلتزم العميل بإكمال الدفع قبل شحن الشحنة.
14 سياسة العميل
الأهلية القانونية:
يجب أن يكون العميل مؤهلاً قانونيًا لتقديم طلبات حجز الخدمات من خلال منصة بوليصات، بما يتوافق مع الأنظمة المعمول بها في المملكة العربية السعودية. في حال عدم توافر الأهلية القانونية، يتعين على العميل الامتناع عن إبرام أي معاملات عبر المنصة.
إنشاء الحساب:
يشترط على العميل إنشاء حساب لدى منصة بوليصات ليتمكن من تقديم الطلبات ومتابعتها. يتعين على العميل إدخال بيانات دقيقة وصحيحة أثناء التسجيل، على أن تكون هذه البيانات قانونية وقابلة للتحقق.
مراجعة تفاصيل الخدمات:
يتحمل العميل مسؤولية الاطلاع على كافة تفاصيل الخدمات المعلن عنها قبل تقديم الطلب. يُعتبر تأكيد الطلب موافقة نهائية على الخدمة، ولا يُسمح باسترجاع المبالغ المدفوعة إلا وفق سياسة الإلغاء المعتمدة.
الالتزام بالأحكام:
يلتزم العميل بجميع الأحكام الواردة في اتفاقية استخدام منصة بوليصات، بما في ذلك السياسات المتعلقة الخدمات والسياسات الأخرى المنظمة لاستخدام المنصة، ويتعين عليه الامتثال للأنظمة السعودية المعمول بها أثناء استخدام الخدمات.
المسؤولية عن المواد المحظورة أو المقيدة:
يتحمل العميل المسؤولية الكاملة عن أي أضرار أو مسؤوليات قانونية ناتجة عن محاولة شحن أي من المواد المحظورة أو المقيدة وفقًا للقوانين المعمول بها في المملكة العربية السعودية. وفي حال اكتشاف أي شحنة تحتوي على مواد محظورة، يحق لشركة الشحن رفضها أو مصادرتها دون أي تعويض أو استرداد للمبلغ المدفوع. علمًا بأنه قد يتم إبلاغ الجهات المختصة في حال الاشتباه بوجود شحنات غير قانونية، ويتحمل العميل تبعات ذلك قانونيًا.
المسؤولية عن الشحنات:
منصة بوليصات غير مسؤولة عن الشحنات المرسلة من قبل التاجر أو العميل، بغض النظر عن نوعها أو محتوياتها. ويتحمل المرسل (التاجر أو العميل) المسؤولية الكاملة عن شحنته ومحتواها، وأي مساءلة قانونية قد تنتج عنها.
الإفصاح عن محتويات الشحنة:
في حال طلب موظف شركة الشحن الإفصاح عن محتويات الشحنة، يجب على المرسل تقديم معلومات صحيحة ودقيقة عن الشحنة. ويُحظر شحن أي منتج محظور أو غير آمن وفقًا لقوانين المملكة العربية السعودية، ويُحمل المرسل المسؤولية القانونية الكاملة عن أي مخالفة. ويتعهد العميل بالإفصاح الكامل عن محتويات الشحنة والتأكد من صحتها عند الطلب.
المسؤولية عن الأوزان والأبعاد:
يقر العميل بأن إدخال أوزان أو أبعاد خاطئة قد يؤدي إلى إعادة احتساب السعر أو رفض الشحنة أو تأخيرها. ويحق لشركات الشحن إعادة قياس الشحنات، وفي حال وجود اختلاف بين الوزن المُعلن والوزن الفعلي أو الحجمي، سيتم تعديل التكلفة وفقًا للوزن الفعلي أو الحجمي الجديد.
الالتزام بتوفير العنوان الوطني:
يلتزم العميل بإدخال العنوان الوطني الصحيح والكامل للمستلم عند إنشاء أي طلب شحن عبر منصة بوليصات، وذلك امتثالًا للتعليمات التنظيمية الصادرة عن الهيئة العامة للنقل في المملكة العربية السعودية، والتي تشترط عدم قبول أو تسليم الشحنات البريدية دون عنوان وطني معتمد اعتبارًا من 1 يناير 2026. ويتحمل العميل المسؤولية الكاملة عن صحة ودقة بيانات العنوان الوطني المدخلة، وتشمل (رقم المبنى، اسم الشارع، الحي، المدينة، الرمز البريدي، والرقم الإضافي). وفي حال عدم إدخال العنوان الوطني أو إدخاله بشكل غير صحيح، يحق لبوليصات أو لشركة النقل رفض الشحنة أو تعليق تنفيذها دون أدنى مسؤولية على بوليصات.
المسؤولية القانونية الناتجة عن إخفاء معلومات:
يتحمل العميل المسؤولية الكاملة عن أي أضرار أو عواقب قانونية تنتج عن إخفاء معلومات تتعلق بمحتوى الطرد. ويلتزم المرسل بتحمل كافة التبعات القانونية والمسؤوليات الناشئة عن الشحنة المخالفة، بما في ذلك أي غرامات أو عقوبات تفرضها الجهات التنظيمية.
المسؤولية عن الشحنات المصادرة:
منصة بوليصات لا تتحمل أي مسؤولية قانونية أو مالية عن الشحنات المصادرة نتيجة مخالفة الأنظمة أو الشحنات التي تحتوي على مواد محظورة. وأي ضرر أو تأخير يحدث نتيجة إجراءات التفتيش أو المصادرة يقع ضمن نطاق مسؤولية العميل أو المرسل.
15 سياسة الدفع
طرق الدفع المتاحة:
تتم جميع عمليات الدفع داخل منصة بوليصات من خلال المحفظة الإلكترونية الخاصة بالعميل، والتي يجب شحنها مسبقًا لاستخدام الخدمات. ولا تدعم بوليصات الدفع النقدي أو الدفع عند الاستلام، وجميع المدفوعات تتم إلكترونيًا فقط عبر المنصة.
إتمام الدفع:
عند استخدام خدمات المنصة، يتم خصم المبلغ المستحق تلقائيًا من المحفظة الإلكترونية للعميل عند إتمام الطلب. ويتحمل العميل مسؤولية شحن محفظته بالمبلغ الكافي لضمان تنفيذ الطلبات دون تأخير.
عدم الاسترداد:
جميع المدفوعات التي تتم عبر المنصة نهائية وغير قابلة للاسترداد، ويجب على العميل التحقق من صحة معلوماته قبل تأكيد الدفع. وفي حال وجود خطأ تقني أو مشكلة في المعاملة، يمكن للعميل التواصل مع دعم العملاء، وسيتم مراجعة الحالة وفقًا لسياسات بوليصات الداخلية.
المسؤولية عن الدفع:
يلتزم العميل بمراقبة نشاط حسابه والتأكد من عدم وجود أي استخدام غير مصرح به لمحفظته الإلكترونية. وتحتفظ بوليصات بالحق في تعليق أو حظر الحساب في حال اكتشاف أي أنشطة مشبوهة أو احتيالية تتعلق بالدفع.
16 سياسة المحفظة الإلكترونية
إنشاء المحفظة الإلكترونية:
يتم إنشاء محفظة إلكترونية تلقائيًا لكل مستخدم عند تسجيل حسابه في منصة بوليصات، وتُستخدم لإتمام عمليات الدفع للخدمات المتاحة.
شحن المحفظة:
يمكن للعميل شحن محفظته الإلكترونية باستخدام وسائل الدفع المعتمدة، مثل التحويل البنكي أو الدفع الإلكتروني عبر مزودي الخدمة المعتمدين. ولا يتم احتساب أي فوائد أو أرباح على الرصيد الموجود في المحفظة، حيث تستخدم فقط كوسيلة دفع داخل المنصة.
استخدام الرصيد:
يمكن استخدام الرصيد المتاح في المحفظة لإصدار بوالص الشحن ودفع الرسوم المستحقة على الطلبات. ويتم خصم المبلغ تلقائيًا من المحفظة بمجرد إتمام العميل لعملية شراء البوليصة.
عدم تحويل الرصيد:
لا يمكن للعميل تحويل الرصيد المتاح في محفظته إلى حسابات أخرى داخل المنصة أو إلى حسابات بنكية خارجية. والرصيد في المحفظة غير قابل للاسترداد نقدًا، ويمكن استخدامه فقط داخل منصة بوليصات.
صلاحية الرصيد:
يبقى الرصيد المضاف في المحفظة ساري المفعول طالما أن الحساب نشط. وفي حال عدم استخدام الحساب لفترة طويلة، قد يتم تطبيق سياسة إلغاء أو تجميد الرصيد وفقًا لتقدير إدارة المنصة.
المسؤولية عن الحساب:
يتحمل العميل المسؤولية الكاملة عن إدارة محفظته الإلكترونية، ويجب عليه اتخاذ الإجراءات اللازمة لحماية حسابه من أي استخدام غير مصرح به. وفي حال الاشتباه في احتيال أو إساءة استخدام المحفظة، تحتفظ بوليصات بالحق في تعليق أو حظر الحساب واتخاذ الإجراءات القانونية اللازمة.
17 سياسة الاسترداد
حالات الاسترداد:
يتم الاسترداد في حالات قبول الإلغاء وفقًا لسياسة الإلغاء الخاصة بالمنصة فقط.
الاسترداد إلى المحفظة الإلكترونية:
سيتم إعادة المبلغ المدفوع إلى المحفظة الإلكترونية الخاصة بالعميل، والمبالغ المستردة لا يمكن تحويلها إلى حسابات بنكية أو أي وسيلة دفع أخرى، حيث تظل داخل المحفظة الإلكترونية للاستخدام المستقبلي من قبل العميل في منصة بوليصات، فالاسترداد يتم فقط داخل المنصة ولا يتم إرجاع المبالغ نقدًا أو عبر أي وسيلة دفع أخرى.
إجراءات الاسترداد:
في حال قبول طلب الاسترداد بناءً على سياسة الإلغاء، سيقوم فريق بوليصات بتقييم الطلب ومن ثم تنفيذ إعادة المبلغ إلى المحفظة الإلكترونية الخاصة بالعميل. يمكن للعميل استخدام الرصيد المسترد في إجراء معاملات جديدة داخل المنصة أو شحن محفظته الإلكترونية وفقًا لاحتياجاته.
18 سياسة التلف والتعويض
مسؤولية التغليف:
يلتزم العميل (التاجر أو المرسل) بتغليف الشحنة الخاصة به بشكل صحيح وآمن قبل تسليمها إلى شركة الشحن، ويخضع التغليف للضوابط الآتية:
يجب أن يكون التغليف مناسبًا لجميع المواد المرسلة وأن يكون باستخدام كرتون أو كيس الشحنة المخصص والذي يتم تزويده من قبل شركة الشحن أو من قبل العميل (المرسل).
في حالة الشحنات التي تحتوي على مواد قابلة للكسر أو حساسة، يجب أن يتم تغليف الشحنة بطبقتين على الأقل، بالإضافة إلى استخدام أكياس الفقاعات أو مواد خاصة أخرى لحماية المواد القابلة للكسر من التلف.
يجب على العميل إلصاق ملصق "قابل للكسر" على الشحنة، لتنبيه شركة الشحن والعاملين المعنيين بوجود مواد قابلة للكسر داخل الشحنة.
قيود الشحن على المنتجات الثقيلة:
يلتزم العميل بعدم شحن المنتجات الثقيلة التي تتجاوز وزنها الفعلي أو حجمي الوزن الذي تم تحديده بموجب الاتفاقية مع شركة الشحن. وفي حال تجاوزت الشحنة الوزن المتفق عليه، يتم تطبيق الرسوم الزائدة أو قيود إضافية على الشحنة، وفقًا لسياسات شركة الشحن المعنية.
مسؤولية الأضرار أثناء النقل:
في حال تعرضت الشحنة إلى تلف أو كسر جزئي أو كلي أثناء النقل، فإن المسؤولية عن التعويضات ستكون وفقًا لسياسات شركة الشحن المتبعة، بما في ذلك التحقيقات المتعلقة بحالة الشحنة، ويجب على العميل التقدم بمطالبة لشركة الشحن المعنية وفقًا لسياساتها المتعلقة
تحديد المسؤولية:
يتم تحديد مسؤولية الأطراف على النحو التالي:
المرسل (العميل) وشركة الشحن هما المسؤولان الوحيدان عن محتويات الشحنة، وأي أضرار أو تلف قد يحدث أثناء النقل أو بسبب النقل، أو بسبب أي عوامل أخرى.
منصة بوليصات والعاملون بها لا يتحملون أي مسؤولية أو تعويضات مادية أو معنوية بشأن الشحنات بعد تسليم البوليصة إلى العميل (المرسل) أو إلى من ينوب عنه.
مسؤولية بوليصات تنتهي بمجرد تسليم البوليصة (التي تم إصدارها بشكل آلي أو يدوي أو بأي طريقة أخرى) إلى المرسل أو من ينوب عنه.
عدم مسؤولية بوليصات:
لا تكون منصة بوليصات مسؤولة عن أي أضرار أو خسائر مادية أو معنوية قد تحدث بعد تسليم البوليصة لشركة الشحن، ولا يتم تحمل أي تبعات قانونية أو مالية تتعلق بالتلف أو فقدان الشحنة أثناء النقل. كما أنه في حالة وجود أي ضرر يحدث للشحنة، لا تكون منصة بوليصات ملزمة بتعويض العميل عن تلك الأضرار.
19 التقييمات
أهداف التقييمات والآراء:
تهدف التقييمات إلى تحسين جودة الخدمات المقدمة بناءً على آراء وملاحظات العملاء. تُعتبر التقييمات أداة لتعزيز الشفافية وزيادة الثقة بين المنصة والعملاء، وأداة لمقدمي الخدمات للاطلاع على آراء العملاء وتحسين خدماتهم بشكل مستمر.
أهلية التقييم:
يُسمح بتقديم التقييمات للعملاء أو الزوار الذين استفادوا من خدمات المنصة و/أو مقدمي الخدمات بشكل مباشر. يجب أن يعكس التقييم تجربة شخصية حقيقية وأن يكون صادقًا وموضوعيًا وغير متحيز.
محتوى التقييمات:
يجب أن تكون التقييمات لائقة وخالية من أي لغة مسيئة، تهديدات، أو تعليقات غير قانونية. يُحظر نشر تقييمات تتضمن: (معلومات كاذبة أو مضللة، محتوى ينتهك حقوق الملكية الفكرية أو العلامات التجارية، إشارات أو مقارنات مع كيانات أخرى بطريقة غير قانونية أو غير لائقة).
مراجعة التقييمات:
تحتفظ المنصة بالحق في مراجعة جميع التقييمات قبل نشرها للتأكد من توافقها مع هذه السياسة. يحق للمنصة حذف أو تعديل أي تقييم ينتهك البنود المذكورة دون إشعار مسبق.
استخدام التقييمات:
تُصبح التقييمات المقدمة جزءًا من محتوى المنصة، ويجوز استخدامها لأغراض تسويقية أو لتحسين الخدمات.
المسؤولية القانونية:
يتحمل العملاء المسؤولية القانونية الكاملة عن التقييمات التي ينشرونها، بما في ذلك أي دعاوى قانونية قد تنشأ عنها. يوافق العملاء على تعويض المنصة عن أي أضرار أو مطالبات تنتج عن التقييمات المخالفة لهذه السياسة أو القوانين السارية.
التعامل مع التقييمات السلبية:
نُشجع العملاء الذين واجهوا تجربة سلبية على التواصل المباشر مع إدارة المنصة قبل نشر تقييمهم لإتاحة الفرصة لحل المشكلة بشكل ودي. يتم التعامل مع التقييمات السلبية بمهنية واهتمام لتحسين تجربة العملاء.
النزاعات المتعلقة بالتقييمات:
في حال نشوء نزاع بشأن أي تقييم منشور، تحتفظ المنصة بالحق في مراجعة النزاع واتخاذ الإجراءات المناسبة. تُطبق القوانين السارية في المملكة العربية السعودية لحل أي نزاعات تتعلق بالتقييمات.
التعديلات على السياسة:
يُعد تقديم التقييم بمثابة موافقة ضمنية على سياسة التقييمات هذه. تحتفظ المنصة بالحق في تعديل هذه السياسة في أي وقت، مع إشعار العملاء بالتعديلات عند الحاجة.
إخلاء المسؤولية:
يُقر العميل بأن التقييمات التي يُقدمها تُعبر عن رأيه الشخصي فقط. لا تتحمل المنصة أي مسؤولية قانونية عن محتوى التقييمات المنشورة من قبل العملاء، إلا في الحدود التي ينص عليها القانون.
20 سياسة الاستخدام
قبول الشروط:
يُعد استخدام خدمات منصة بوليصات موافقة ضمنية على الالتزام بجميع الشروط الواردة في هذه السياسة، بالإضافة إلى السياسات الأخرى ذات الصلة.
الأهلية القانونية:
يشترط أن يكون المستخدم مؤهلًا قانونيًا لاستخدام الخدمات وفقًا للأنظمة السارية في المملكة العربية السعودية. في حال كان المستخدم قاصرًا (أقل من 18 عامًا)، يُشترط الحصول على موافقة ولي الأمر أو الوصي القانوني.
الاستخدام المسموح:
يجب استخدام الخدمات للأغراض المشروعة والمصرح بها فقط. يُحظر القيام بأي من الأفعال التالية:
نشر أو إرسال أي محتوى غير قانوني، مسيء، أو مخالف للآداب العامة.
محاولة اختراق أو تعطيل أنظمة المنصة التقنية.
استغلال الخدمات بطرق تؤدي إلى الإضرار بسمعة المنصة أو تعطيل عملياتها.
استخدام الحسابات أو البيانات الخاصة بالآخرين دون إذن.
التزامات المستخدم:
يلتزم المستخدم بتقديم بيانات دقيقة وصحيحة عند إنشاء الحساب أو إجراء المعاملات. يتحمل المستخدم مسؤولية حماية بيانات الدخول إلى حسابه، ولا يجوز له مشاركة هذه البيانات مع أي طرف آخر. أي نشاط يتم من خلال حساب المستخدم يُعتبر من مسؤوليته الشخصية.
مسؤولية المستخدم:
يتحمل المستخدم المسؤولية الكاملة عن جميع الأنشطة التي يقوم بها أثناء استخدام الخدمات، بما في ذلك أي عواقب أو أضرار تنشأ عن ذلك. المنصة غير مسؤولة عن الأضرار التي قد تنتج عن سوء استخدام الخدمات.
حقوق المنصة:
تحتفظ المنصة بحق تعليق أو إنهاء الحسابات التي تنتهك بنود هذه السياسة أو تتسبب في أضرار مادية أو معنوية للمنصة أو مستخدميها. يحق للمنصة تعديل أو إيقاف أي خدمة في أي وقت دون إشعار مسبق. يحق للمنصة استخدام أي محتوى يتم تقديمه (مثل التقييمات أو الاقتراحات) لأغراض تطوير الخدمات أو التسويق دون أي التزام مالي تجاه المستخدم.
تحديث السياسة:
تحتفظ منصة بوليصات بحق تعديل هذه السياسة متى دعت الحاجة، مع إخطار المستخدمين بالتعديلات الجوهرية قبل تطبيقها. يُعتبر استمرار المستخدم في استخدام الخدمات بعد التعديل قبولًا للتغييرات المحدثة.
إنهاء الاستخدام:
للمستخدم الحرية في التوقف عن استخدام الخدمات في أي وقت، مع مراعاة الوفاء بجميع الالتزامات المالية أو التعاقدية القائمة. للمنصة الحق في إنهاء أو تعليق وصول المستخدم للخدمات في حال انتهاكه لأي بند من هذه السياسة.
حدود المسؤولية:
لا تتحمل المنصة أي مسؤولية عن الأضرار الناتجة عن سوء استخدام الخدمات أو الانتهاكات التي يقوم بها المستخدمون. يتحمل المستخدم وحده أي التزامات قانونية قد تنشأ عن تصرفاته أثناء استخدام الخدمات.
21 التراخيص
تشمل التراخيص:
استخدام المنصة الإلكترونية والتطبيق، والوصول إلى المحتوى الرقمي والخدمات المادية أو الإلكترونية المقدمة من المنصة، والاستفادة من البرامج والمزايا المرتبطة بالخدمات.
شروط منح التراخيص:
يتم منح المستخدمين ترخيصًا غير حصري، غير قابل للتحويل، ومحدد الاستخدام بما يتوافق مع هذه السياسة وسياسات المنصة الأخرى. تُستخدم التراخيص للأغراض الشخصية أو التجارية المحددة فقط، شريطة الامتثال للقوانين واللوائح المعمول بها في المملكة العربية السعودية.
الاستخدام المحظور للتراخيص:
يُحظر على المستخدمين ما يلي:
استخدام التراخيص بطرق مخالفة للشروط المنصوص عليها في هذه السياسة.
نسخ أو توزيع أو تعديل أو استغلال أي جزء من الخدمات أو المحتوى دون إذن كتابي مسبق.
إعادة بيع التراخيص أو استخدامها لأغراض غير مصرح بها.
اختراق أو عكس هندسة أي جزء من الخدمات أو الأنظمة التقنية للمنصة.
يُعد أي استخدام غير مصرح به للتراخيص انتهاكًا لهذه السياسة، ويكون للمنصة الحق في اتخاذ الإجراءات القانونية اللازمة.
تعديل وإلغاء التراخيص:
تحتفظ منصة بوليصات بالحق في:
تعديل شروط التراخيص في أي وقت وفقًا لما يراه مناسبًا، مع إشعار المستخدمين عند الحاجة.
إنهاء أو تعليق أي ترخيص إذا: خالف المستخدم شروط هذه السياسة أو أي سياسة أخرى للمنصة، أو استُخدمت التراخيص بطرق غير مشروعة أو مخالفة للقوانين، أو لم يلتزم المستخدم بالتزاماته المالية أو التعاقدية.
الإقرار والموافقة:
باستخدام خدمات منصة بوليصات، يُقر المستخدم بأنه قد قرأ ووافق على جميع بنود سياسة التراخيص. استمرار استخدام الخدمات بعد أي تعديل على شروط التراخيص يُعد قبولًا ضمنيًا بالشروط المعدلة. في حالة إنهاء الترخيص، يُحظر على المستخدم الاستمرار في استخدام أي جزء من الخدمات المرتبطة به.
22 سياسة المحتوى
مسؤولية المستخدم عن المحتوى:
يتحمل المستخدم المسؤولية الكاملة عن المحتوى الذي يقدمه أو ينشره عبر منصة بوليصات. يضمن المستخدم أن المحتوى المقدم:
أصلي وغير منسوخ أو منتهك لحقوق الملكية الفكرية لأي طرف ثالث.
خالٍ من المواد المسيئة أو غير القانونية أو التي تنتهك القوانين واللوائح المعمول بها.
صادق ودقيق، ولا يحتوي على معلومات مضللة أو خادعة.
حقوق المنصة تجاه المحتوى:
تحتفظ منصة بوليصات بالحق في مراجعة، تعديل، أو حذف أي محتوى ينتهك هذه السياسة، القوانين، أو شروط الاستخدام. يحق للمنصة تعليق أو حظر حساب أي مستخدم ينشر محتوى مخالفًا للسياسة أو يضر بالمنصة أو بأي طرف آخر.
ترخيص استخدام المحتوى:
بمنح المستخدم المحتوى أو نشره على منصة بوليصات، تُمنح المنصة ترخيصًا دائمًا، غير حصري، وقابلًا للنقل لاستخدام هذا المحتوى بما يتوافق مع أهداف المنصة. يشمل هذا الترخيص: النسخ، التعديل، النشر، التوزيع، أو العرض، مع ضمان عدم المساس بسمعة المستخدم أو حقوقه. يمكن للمنصة استخدام المحتوى لأغراض تسويقية، ترويجية، أو توثيقية.
قيود على المحتوى المحظور:
يُمنع نشر أو تحميل أي محتوى يحتوي على ما يلي:
مواد تروج للتمييز، العنصرية، الكراهية، أو العنف.
معلومات شخصية أو سرية دون إذن أصحابها.
انتهاكات لحقوق الملكية الفكرية أو العلامات التجارية.
روابط أو برمجيات خبيثة أو فيروسات.
محتوى يضر بسمعة منصة بوليصات أو يخالف القوانين واللوائح.
الإبلاغ عن المحتوى المخالف:
يحق للمستخدمين الإبلاغ عن أي محتوى يُعتقد أنه مخالف لهذه السياسة. تلتزم إدارة المنصة بمراجعة البلاغات واتخاذ الإجراءات المناسبة، بما في ذلك حذف المحتوى المخالف أو تعليق الحساب المسؤول.
ضمانات ودقة المحتوى:
تسعى منصة بوليصات إلى ضمان موثوقية المحتوى الذي ينشره، لكنها لا تضمن خلوه من الأخطاء أو التحديثات المستمرة. يتحمل المستخدم مسؤولية التحقق من صحة المحتوى قبل استخدامه لاتخاذ أي قرارات أو إجراءات.
23 سياسة الإبلاغ عن المحتوى
المحتوى الذي يمكن الإبلاغ عنه:
يمكن الإبلاغ عن المحتوى الذي يتضمن:
انتهاك حقوق الملكية الفكرية (مثل حقوق النشر أو العلامات التجارية).
التمييز، العنصرية، الكراهية، أو العنف.
نشر معلومات شخصية أو حساسة دون موافقة أصحابها.
مواد ضارة (مثل الفيروسات أو البرمجيات الخبيثة).
مواد إباحية، مسيئة، أو غير قانونية.
محتوى يسيء لسمعة منصة بوليصات أو يخالف قوانين المملكة العربية السعودية.
كيفية تقديم البلاغ:
يتم تقديم البلاغ عبر القنوات الرسمية، مثل نموذج الإبلاغ أو البريد الإلكتروني المخصص. يجب أن يتضمن البلاغ وصفًا دقيقًا للمحتوى المخالف وموقعه (مثل رابط أو تفاصيل النشر).
التحقق من البلاغ:
يقوم فريق المحتوى بمراجعة البلاغ للتحقق من صحته ومدى تطابقه مع سياسات منصة بوليصات.
الإجراءات:
حذف المحتوى المخالف أو اتخاذ الإجراءات المناسبة بناءً على درجة المخالفة، أو تنبيه المستخدم المسؤول عن المحتوى أو تعليق حسابه عند تكرار المخالفات.
إخطار المبلّغ:
يتم إبلاغ المبلّغ بالإجراءات المتخذة.
التزامات المستخدمين:
يلتزم المستخدم بتقديم معلومات دقيقة وصحيحة عند تقديم البلاغ، وعدم إساءة استخدام نظام الإبلاغ للإضرار بمصالح الآخرين أو المنصة. ويلتزم المستخدم باحترام خصوصية الأطراف الأخرى عند تقديم البلاغات.
حقوق منصة بوليصات:
يحق للمنصة رفض البلاغات غير المدعومة بأدلة كافية أو التي تُعتبر كيدية، أو اتخاذ الإجراءات المناسبة ضد البلاغات الكيدية أو إساءة استخدام النظام، أو تعديل أو حذف المحتوى المخالف دون إشعار مسبق.
الخصوصية:
تحترم منصة بوليصات خصوصية المبلّغ والمستخدم الذي تم الإبلاغ عنه. ولا يتم الكشف عن هوية المبلّغ إلا إذا طُلب ذلك قانونيًا أو بأمر قضائي.
تعديلات السياسة:
يحق لمنصة بوليصات تعديل هذه السياسة في أي وقت. ويتم إخطار المستخدمين بالتعديلات عند الضرورة. استمرار استخدام المنصة يُعد قبولًا ضمنيًا للتعديلات.
الالتزام:
يقر المستخدمون بقراءة وفهم سياسة الإبلاغ عن المحتوى ويلتزمون بأحكامها. ويحق للمنصة اتخاذ الإجراءات القانونية المناسبة في حال انتهاك هذه السياسة.
24 الأطراف الثالثة
تتعاون منصة بوليصات مع الأطراف الثالثة لتقديم خدمات بحرية متنوعة تشمل تنظيم الرحلات، تأمين خدمات الإرشاد، توفير المعدات البحرية، وخدمات النقل البحري. تخضع علاقة المنصة بالأطراف الثالثة لعقود قانونية تحدد الالتزامات والحقوق، مع التزام جميع الأطراف بالقوانين واللوائح المعمول بها في المملكة العربية السعودية.
مسؤوليات الأطراف الثالثة:
يتحمل الطرف الثالث المسؤولية عن جودة الخدمات أو المنتجات المقدمة. يلتزم بتعويض الأضرار الناتجة عن إهماله أو تقصيره، وحماية بيانات المستخدمين وسرية المعلومات في الخدمات التقنية.
مسؤوليات منصة بوليصات:
تختار المنصة الأطراف الثالثة بعناية بناءً على معايير الجودة والكفاءة، ويتابع أداء الأطراف الثالثة دوريًا لضمان الالتزام بالمعايير، لكنه غير مسؤول عن أي أضرار خارج نطاق الاتفاقيات المبرمة.
مسؤوليات المستخدمين:
احترام حقوق الأطراف الثالثة وعدم الإساءة إليهم. يتحمل المستخدم مسؤولية التعامل المباشر مع الطرف الثالث وأي نزاعات قد تنشأ عنه. تقديم معلومات دقيقة وصحيحة عند التعامل مع الأطراف الثالثة.
إخلاء المسؤولية:
لا تتحمل منصة بوليصات المسؤولية عن أضرار أو خسائر ناتجة عن استخدام خدمات الأطراف الثالثة، إلا في حالة الإهمال المباشر من المنصة. في حال النزاعات، يجب محاولة حلها بين المستخدم والطرف الثالث بشكل مباشر.
الإبلاغ عن المخالفات:
يمكن للمستخدمين الإبلاغ عن أي مخالفات من الأطراف الثالثة عبر القنوات المخصصة. تتحقق منصة بوليصات من البلاغات ويتخذ الإجراءات المناسبة وفق العقود.
التعديلات على السياسة:
تحتفظ منصة بوليصات بالحق في تعديل هذه السياسة وإخطار الأطراف ذات الصلة. استمرار التعامل يُعد قبولًا للتعديلات.
الالتزام:
يقر المستخدمون والأطراف الثالثة بقراءة وفهم هذه السياسة والالتزام بها، ويحق لمنصة بوليصات إنهاء التعامل مع أي طرف ثالث يخالف السياسة أو القوانين المعمول بها.
25 حقوق الملكية الفكرية
جميع حقوق الملكية الفكرية المتعلقة بمنصة بوليصات، بما في ذلك الموقع الإلكتروني، التطبيق، الشعارات، العلامات التجارية، المحتوى الرقمي، التصميمات، الأكواد البرمجية، الصور، النصوص، ومقاطع الفيديو، مملوكة بالكامل لمنصة بوليصات أو الجهات المرخص لها بذلك. يُحظر على المستخدمين أو أي طرف ثالث نسخ أو إعادة إنتاج أو توزيع أو تعديل أو استخدام أي جزء من المحتوى أو الملكية الفكرية للمنصة دون الحصول على إذن كتابي مسبق من منصة بوليصات.
يحظر استغلال حقوق الملكية الفكرية للمنصة لأي غرض ينتهك القوانين أو يتعارض مع أهداف المنصة، مثل الاستخدام التجاري غير المصرح به أو إعادة البيع. تحتفظ منصة بوليصات بحقه في اتخاذ الإجراءات القانونية المناسبة ضد أي انتهاك لحقوق الملكية الفكرية الخاصة به، بما في ذلك المطالبة بالتعويض عن أي أضرار أو خسائر قد تنتج عن ذلك. لا يمنح استخدام خدمات المنصة أو تصفحها أي حقوق أو تراخيص ضمنية للمستخدمين فيما يتعلق بأي من حقوق الملكية الفكرية التابعة لمنصة بوليصات. في حال رغبة أي جهة في استخدام أي جزء من محتوى المنصة لأغراض مشروعة، يجب عليها تقديم طلب رسمي والحصول على موافقة خطية من منصة بوليصات.
يحتفظ الأطراف الثالثة بحقوق الملكية الفكرية لخدماتهم ومنتجاتهم، ويُحظر استخدام العلامات التجارية أو حقوق الملكية الفكرية دون إذن مسبق.
26 المسئولية القانونية
المسؤولية الشخصية:
يتحمل كل مستخدم المسؤولية الكاملة عن جميع الأفعال والأنشطة التي يقوم بها من خلال منصة بوليصات. وتُعفى المنصة من أي مسؤولية قانونية تضامنية أو تبعية تنشأ عن تصرفات المستخدمين.
الالتزام بالشروط والسياسات:
يجب على المستخدمين الالتزام بجميع الشروط والسياسات الخاصة بمنصة بوليصات. تُعد جميع البنود المنصوص عليها في الوثائق والسياسات المعلنة ملزمة قانونيًا.
الامتثال للقوانين المحلية:
يتحمل المستخدم المسؤولية الكاملة عن أي انتهاك للقوانين الوطنية في الدولة التي يستخدم فيها خدمات المنصة. ولا تتحمل منصة بوليصات أي مسؤولية تضامنية أو تبعية تتعلق بمثل هذه المخالفات.
انتهاك حقوق المنصة:
يُعتبر المستخدم مسؤولًا قانونيًا عن أي انتهاك لحقوق منصة بوليصات أو إساءة استخدام عناصر المنصة أو ممتلكاتها بأي شكل كان.
طلبات الحجز الوهمية:
يتحمل المستخدم المسؤولية القانونية الكاملة عن أي طلبات حجز وهمية أو استخدام غير قانوني لخدمات منصة بوليصات، بما في ذلك التعويض عن الأضرار الناتجة.
إساءة استخدام الخدمات:
يكون المستخدم مسؤولًا عن أي إساءة لاستخدام الخدمات المقدمة من منصة بوليصات، ويتحمل العواقب القانونية والتعويضات عن أي أضرار ناتجة.
الإساءة للمنصة:
يتحمل المستخدم المسؤولية القانونية في حال إساءته للمنصة، سواء عبر المواقع الإلكترونية أو التطبيقات أو وسائل التواصل الاجتماعي أو البريد الإلكتروني أو أي وسيلة أخرى.
الإساءة للآخرين:
يتحمل المستخدم المسؤولية الكاملة عن أي إساءة أو ضرر يلحق بالآخرين عبر استخدام خدمات منصة بوليصات، ولا تتحمل المنصة أي مسؤولية قانونية عن ذلك.
تعويض المنصة عن الأضرار:
يلتزم المستخدم بتعويض منصة بوليصات عن أي خسائر أو أضرار ناجمة عن استخدام غير قانوني أو غير مصرح به للخدمات، سواء من قِبله أو من قِبل من ينوب عنه.
تعويض عن الإساءة:
يلتزم المستخدم بتعويض منصة بوليصات عن أي إساءة أو ضرر موجه لإدارة المنصة أو موظفيها أو شركائها أو وكلائها أو أي جهة مرتبطة بها.
حفظ الحقوق القانونية:
تحتفظ منصة بوليصات بجميع حقوقها القانونية المنصوص عليها في هذه السياسة. ولا يُعتبر عدم ممارسته لأي من هذه الحقوق في أي وقت تنازلًا عنها، حيث تبقى جميع الحقوق محفوظة له في جميع الأوقات.
27 إخلاء المسئولية
تقديم الخدمات كما هي:
تقدم منصة بوليصات خدماتها "كما هي" دون أي ضمانات صريحة أو ضمنية إلا تلك المنصوص عليها في الاتفاقيات الرسمية. يتحمل المستخدم المسؤولية الكاملة عن استخدام الخدمات والمنتجات، بما في ذلك العواقب الناتجة عن قراراته الشخصية.
إخلاء المسؤولية عن الأضرار:
لا تتحمل المنصة مسؤولية أي أضرار مباشرة أو غير مباشرة ناتجة عن استخدام خدماتها، إلا في حالة وجود خطأ جسيم أو إهمال واضح من طرفه. كما تُعفى منصة بوليصات من المسؤولية عن أي أضرار تنشأ عن سوء استخدام الخدمات أو انتهاك الشروط من قبل المستخدم.
مسؤولية الأطراف الثالثة:
تُخلي المنصة مسؤوليتها عن أي أخطاء أو تقصير يرتكبه الأطراف الثالثة المتعاونون معها لتقديم الخدمات. ويُعد المستخدم مسؤولًا عن جميع الالتزامات المتعلقة باستخدام هذه الخدمات.
الأنشطة غير المشروعة:
تعفى منصة بوليصات من أي مسؤولية قانونية عن الأنشطة غير المشروعة أو الخارجة عن إدارتها التي قد تتم عبر منصتها. ويقر المستخدم بأن المنصة لا تملك السيطرة الكاملة على جميع الأفعال التي تتم من خلاله، مع التزامه بالإبلاغ الفوري عن أي ضرر لاتخاذ الإجراءات المناسبة.
التوقف المؤقت أو الدائم:
تحتفظ منصة بوليصات بحق التوقف المؤقت أو الدائم عن تقديم خدماتها، سواء لأسباب إرادية أو خارجة عن إرادتها. وتُعفى المنصة من أي مسؤولية قانونية أو تعويضات قد تنشأ عن هذا التوقف.
التأمين والتعويضات:
لا تقدم منصة بوليصات أي ضمانات أو تأمينات أو تعويضات للمستخدمين. ويقر المستخدم بأن استخدامه للمنصة وخدماتها يتم على مسؤوليته الشخصية بالكامل، مع إعفاء المنصة من أي مسؤولية قانونية عن الأضرار أو الخسائر المحتملة.
المحتوى والتواصل:
لا تتحمل منصة بوليصات مسؤولية المحتوى أو التعليقات المنشورة من قِبل المستخدمين، أو عن أي عمليات تواصل تتم عبر المنصة أو خارجها. كما تُعفى المنصة من أي مسؤولية عن معاملات البيع أو الشراء بين الموردين والعملاء، حيث تقع هذه المعاملات تحت مسؤولية الأطراف المتعاقدة مباشرة.
28 الاتصالات والإشعارات
وسائل التواصل المعتمدة:
تتم جميع الاتصالات الرسمية بين منصة بوليصات والمستخدمين من خلال الوسائل المعتمدة التي توفرها المنصة، مثل البريد الإلكتروني، الرسائل النصية، الإشعارات داخل التطبيق، أو أي وسيلة أخرى تحددها المنصة.
دقة البيانات:
يتحمل المستخدم مسؤولية تقديم معلومات اتصال دقيقة ومحدثة، ويكون مسؤولًا عن أي تبعات تنتج عن عدم استلام الإشعارات بسبب بيانات غير صحيحة أو غير محدثة.
الإشعارات الإدارية:
يُقر المستخدم بأن الإشعارات المرسلة من منصة بوليصات، بما في ذلك الإشعارات المتعلقة بتحديث الشروط أو السياسات، تُعتبر مستلمة بشكل صحيح بمجرد إرسالها عبر الوسيلة المحددة، حتى في حالة عدم قراءتها.
الاستفسارات والشكاوى:
يحق للمستخدمين التواصل مع إدارة منصة بوليصات لتقديم استفساراتهم أو شكاواهم عبر القنوات المخصصة لذلك، مثل البريد الإلكتروني أو نموذج الاتصال المتاح على المنصة. وتلتزم المنصة بالرد على تلك الاستفسارات والشكاوى في أقرب وقت ممكن.
التغييرات والإعلانات:
تحتفظ منصة بوليصات بحق إرسال إعلانات أو إشعارات بشأن التحديثات على خدماته أو شروطه وسياساته. ويعد استمرار استخدام المستخدم للخدمات بعد استلام هذه الإشعارات قبولًا ضمنيًا لها.
حفظ السجلات:
تحتفظ منصة بوليصات بسجلات إلكترونية لجميع الإشعارات والاتصالات المرسلة للمستخدمين كمرجع قانوني عند الحاجة.
29 التعديلات
حق التعديل:
يحق لمنصة بوليصات تعديل أو تحديث هذه الاتفاقية في أي وقت حسب ما يراه مناسبًا، وذلك بناءً على التغييرات التي قد تطرأ على قوانين أو سياسات المنصة أو لأي أسباب أخرى.
إشعار التعديلات:
سيتم إخطار المستخدمين بأي تعديلات جوهرية على هذه الاتفاقية عبر وسائل الإشعار المتاحة، مثل البريد الإلكتروني أو من خلال الإعلانات على الموقع أو التطبيق.
قبول التعديلات:
يُعتبر استمرار استخدام الخدمات بعد الإعلان عن التعديلات بمثابة موافقة ضمنية من المستخدم على التعديلات الجديدة. وفي حال عدم موافقة المستخدم على التعديلات، يحق له التوقف عن استخدام الخدمات والامتناع عن أي تعامل مع المنصة.
نفاذ التعديلات:
تدخل التعديلات حيز التنفيذ فور نشرها على المنصة أو إرسال إشعار للمستخدمين، ما لم يُنص على خلاف ذلك في التعديل نفسه.
30 مدة/إنهاء الاتفاقية
مدة الاتفاقية:
تكون مدة هذه الاتفاقية سارية من تاريخ الموافقة عليها من قبل المستخدم أو بدء استخدامه للخدمات المقدمة من منصة بوليصات، وتستمر حتى إنهاء أو إلغاء الاتفاقية من قبل أي من الطرفين وفقًا لشروط هذه الاتفاقية.
إنهاء الاتفاقية:
يحق لأي من الطرفين إنهاء هذه الاتفاقية في أي وقت، سواء بإشعار مسبق أو دون إشعار، وفقًا لما يسمح به القانون المعمول به ووفقًا للشروط المحددة في هذه الاتفاقية.
الآثار المترتبة على إنهاء الاتفاقية:
في حالة إنهاء هذه الاتفاقية، يتوقف المستخدم عن استخدام أي من خدمات منصة بوليصات فورًا، وتظل بعض البنود (مثل البنود المتعلقة بالمسؤولية القانونية، حقوق الملكية، السرية، إلخ) سارية بعد إنهاء الاتفاقية بحسب ما هو منصوص عليه.
31 الاختصاص القانوني والقضائي
القانون المعمول به:
تخضع هذه الاتفاقية وتنفيذها لأحكام القوانين السارية في المملكة العربية السعودية، ويعتبر القانون السعودي هو القانون الحاكم لأي نزاع ينشأ عن هذه الاتفاقية أو يتعلق باستخدام خدمات المنصة.
الاختصاص القضائي:
يُقر المستخدم بأن أي نزاع أو خلاف ينشأ بينه وبين منصة بوليصات نتيجة لهذه الاتفاقية أو الخدمات المقدمة عبر المنصة سيتم حله أمام المحاكم المختصة في المملكة العربية السعودية، ويُعتبر هذا الاختصاص حصريًا.
حل النزاعات بالوسائل البديلة:
قبل اللجوء إلى المحاكم، يحق للأطراف محاولة حل أي نزاع عبر الوسائل البديلة مثل التفاوض أو الوساطة، ولكن ذلك لا يعفي من الحق في التوجه إلى المحاكم عند الحاجة.
استبعاد البنود:
في حال تم إلغاء أو استبعاد أي بند من بنود هذه الوثيقة بناءً على حكم قضائي، يظل باقي البنود سارية ونافذة بكامل آثارها القانونية، ولا يؤثر ذلك على صحتها أو تنفيذها، ما لم تقرر إدارة منصة بوليصات إلغاء الاتفاقية بالكامل.
32 اللغة العربية
جميع الشروط والأحكام الواردة في هذه الوثيقة تم صياغتها باللغة العربية. في حال حدوث أي ترجمة لهذه الشروط إلى لغات أخرى، فإن النسخة العربية هي النسخة المعتمدة قانونياً. في حال وجود أي تعارض بين النصوص المترجمة والنص باللغة العربية، فإن النص باللغة العربية هو الذي يُطبق ويكون هو المعتمد والملزم لجميع الأطراف.

ساعات العمل:
ساعات العمل الرسمية لدعم العملاء هي من الأحد إلى الخميس، من الساعة 8:00 صباحًا حتى الساعة 6:00 مساءً (بتوقيت المملكة العربية السعودية). ويمكن للعميل إرسال استفساراته في أي وقت، وسيتم الرد عليها خلال ساعات العمل الرسمية.
أغراض الاتصال:
يتم التعامل مع استفسارات الاتصال المتعلقة بما يلي:
الاستفسارات العامة عن خدمات منصة بوليصات.
الدعم الفني المتعلق بمشاكل الحساب أو المنصة.
شكاوى حول الخدمة أو شركات الشحن.
متابعة حالة الشحنات.
الاستفسارات الخاصة بالرسوم أو المدفوعات.
استجابة الشكاوى:
في حال كانت الشكوى تتعلق بمشكلة أو نزاع مع إحدى شركات الشحن، سيتم توجيه الشكوى إلى الشركة المعنية لمراجعتها والرد عليها وفقًا للإجراءات المتبعة، وستتعاون منصة بوليصات مع العميل لضمان الحل الأمثل.
التحديثات والردود:
سيتم الرد على جميع الاستفسارات والشكاوى في غضون 48 ساعة من استلامها، وقد تستغرق بعض الحالات المعقدة وقتًا أطول لحلها، وسيتم إخطار العميل بتقدم الحالة.
خصوصية المعلومات:
جميع المعلومات التي يقدمها العميل عبر طرق الاتصال المختلفة سيتم التعامل معها بسرية تامة ولن يتم استخدامها إلا لغرض معالجة الاستفسار أو الشكوى. ولن يتم الكشف عن أي من هذه البيانات إلا بموجب طلب من الجهات القانونية المختصة.
